Parking Eye Charge

After parking in our local car park i paid for 2 hrs which i returned to car in allotted time. I was photographed entering car park and exciting stating i had been 2hrs 10 mins and purchased insufficient time. I was unaware i had to pay from moment enter to exit time. I feel charge is unfair i appealed using template letter this was refused i have now had letter stating solicitors will be involved. i contacted citizen advice who suggested POPLA however i was over 28 days.
I feel they are bullying us into paying fee as worried about CCJ however i feel i have commitment no offence i had to fine space and enter eg number whilst waiting for ticket machine. Any advice i feel so confused.

this car poark has been in local press laterly for unfair charges.

    parking eye have refused your appeal? what date was the offence , what date did you RECIEVE mail from PE and on what date did you appeal?

    dates are important , note PE have failed to allow grace periods , those would be accepted by POPLa , so you need to get a popla code

  • offence date was 9/4 letter came 14/4 i appealed straight away they sent refusal letter 6/5. i have a popla code but on entering it doesn't work i think as i'm over 28 days

    That's odd. ParkingEye don't use solicitors to issue their claims. Is that letter from a debt collector then?

    Which car park?

    Your time was within the grace period so I am going to suggest you complain by email to ParkingEye telling them this and that you will be complaining to the BPA and DVLA as well as the ICO because there was never any reasonable cause to obtain your data for time parked within their Trade Body's mandatory Grace Periods.

    and copy in:

    ...putting the PCN number into the subject line, of course.

    yes you have only a month to submit an appeal , was there a reason not to?

    PE WILL take you to court , time to read up on grace periods and even get clarification from the BPA

    CM , I spotted that , but needed more info , sounds like a PE cockup , but delivered on time


    I am actually wondering (due to time delay) if this WAS pe or the generic one

  • i'm afraid not appealing in time was just lack of time and an oversight as didn't realise it had to be done in 28 days wasn't until i spoke with citizen advice i realised i only have set time.
    Letters have been from PE stating they will forward instruct solicitors if not paid in full.

    They might not if they are sending debt collector letters and if she sees it off by email now. Even at LBCCC stage, ParkingEye's dogs can be called off with a robust response. Court isn't inevitable and some locations (like Aldi) never result in a claim.

    Weymouth Old town East. not a retail park
    Ive had 2 letters from DRP and another on from PE letter before county court claim.

    I suggest that there is a reason PE are using DR+ , non relivent land? no grace period? who knows

    you might as well contact the BPA and ask them if a grace period is applicable on this car park , both on entry and on exit , give them the location and your PCN number and date

  • My real bug bear is i the left car park within my 2 hours ticket time. although i don't have the ticket i have asked them to produce evidence from machine as we have to enter car reg.

    if it goes to court , GRACE PERIODS (clause #13 of the BPA CoP), will be one of many legal points you will be using in your defence
