Ignorant prat! I would be inclined to leave it because he is just not worth the hassle but if you cant would ring the council. I thought that hanging tree/brach only applied to stuff hanging over to their side, not the whole tree. Surely he should at least have to have a reasonable discussion first before taking matters into his own hands? Also, if he is a housing association resident I would be making a complaint as his actions would certainly be considered unreasonable....but for your own sanity I would go with trying to think "what goes around" and just hope that you are there to see it. I have THE most pathetic, ignorant neighbor and try to adopt this but it can be hard but people like that just arent worth the bother!Nerd no 109 Long haulers supporters DFW #1! Oh dear - how rude of him. It always makes me wonder how people can be so ignorant. How long would it have taken to knock on the door and have a conversation about it?
Maybe you could put a note on freecycle and if anyone can use it for any purpose they can come & help themselves? Before it rains!
I know in the Winter my friend was after all the wood she could get for her boiler in her cellar but obviously I don't know if these cuttings are suitable for that sort of thing...Bank Balance: In the black for the moment.

Fabulous suggestion LookingAhead! My neighbour is always on the scrounge for logs, and some smell lovely when burned. I can always tell when they have their fire going (last night was first time this autumn) as outside smells gorgeous.unsecured Debts at [strike]August 2007 £79,984[/strike] September £79,579 [STRIKE]Snowballing date July 2013[/STRIKE].

OT question: Pania, are you a kiwi? From whakatane? Just curious. And if you aren't, of course, this question will make no sense, so don't worry about it.Mortgage started on 22.5.09 : £129,600Overpayments to date: £3000June grocery challenge: 400/6000

apparently he has every right to cut the hedge, even coming onto our land to do so, but if he takes his crud away it's theft so he's left it for us!!!
Going to have to hire a large trailer to get rid, hoping landlady will help us out!
Just had an incredibly robust conversation with said man, the RUDENESS of it! he HAD a trailer! how dare he just waltz on here, and leave his CR*P for us to clear up!! the hedge looked fine and nice and leafy and the birds had a very happy home there.
I'm FUMING!! anyone got any legal knowledge that may help out on this one?
a very cross Pania.
There are two different possible situations here summed up as: Either he owns the hedge or he doesn't.
If he owns the hedge, then he can come onto your land and maintain it (but there may be legal notice arrangements that I don't know about) - but he has to take his hedge away with him. After all - he owns it. If he doesn't, it's fly tipping - either start a private prosecution or shift it yourself and go through small-claims. Be sure to take plenty photos, and be sure to charge for your time.
If he doesn't own the hedge, then he can trim any part of it up to the boundary between you. If it extends 2 inches over the boundary, then the maximum he can trim is 2 inches. He can not come on to your land, and he must leave the cuttings on your land (or it would be theft). He can not trim any part not over the boundary (including height) or it would be criminal damage.
In conclusion: Find out who owns the hedge. If he does, dump it over the boundary onto his land, then charge him for your time. Get 3 quotes and knock a couple of quid off if you want to do it yourself. Be sure to charge for the time you spend obtaining the quote - itemise it properly."Follow the money!" - Deepthroat (AKA William Mark Felt Sr - Associate Director of the FBI)

Simple solution
dump it on his path....
apart from you dont do it. arrange for a friend to come over and lend you a helping hand.. hell ill do it for a tenner if you want... then you just claim (truthfully) that it was nothing to do with you
then you claim you cant move them back onto your land as he quite rightly stated earlier it would be theft!0 -
We have a garage in a small cul-de-sac where 6 people park their cars - we own the majority of it and allow people free passage across. However one morning after a BBQ with some friends - a neighbour calls demanding that we move a car that is blocking their entrance to their garage. I went out and looked - the angle he was gesticulating at (and by the way he took a picture to proove in a court of law that the car was blocking his garage) was so acute that you could convince a jury that the Titanic missed the iceberg! I almost laughed...after he left, I had one of those great reposts!! Anyway - moral of story - you can't choose your neighbours can you.'Proud To Be Dealing With My Debts' : Member number 632

hey guys wow!! so many replies!! couldn't get on line last night due to technical issues but i'm back now!! thanks so much for all your suggestions.
KuneKune, No i'm not, but i want to be!!!! I've been to whakatane and have a friend that lives very nearby. My heart lives permanently in newzealand, i think about the place everyday, maybe one day my body will get chance to rejoin it.
ZTD fantastic suggestions there thanks. I think my biggest issue id the volume of the stuff he's left behind. It stretches the length of the hedge which is about 5 meters and coms 3 metres out and 3 foot up from there.
The ladylady has said that she will try to get someone to come and take it away and was ready to clump him one yesterday.
had he have asked i wouldn't have minded i think what got my goat is the fact he didn't ask. He presumed we had the money to dispose of it.
Ownership of the hedge is another matter and one for the deeds as it forms a boundary marker and isn't hanging over a fence set behind it.
I think to be honest i'll just go with the bonfire idea, and move it as close as i can get to his boundary so they cop the full effect!!
Spaniel the massive speakers would be very grateful, think of it, big bonfire, blaring music til late at night AHAHAHAHAHAHAHAHAHHHAHAHAHAHAHA!!!!!!!!debt @05/11/11 £12210.63!! slowly chipping away!!:heart2:impossible is nothing.:heart2:0 -
