    When you booked this place were you told it was a BnB? If so then what you have there is a holiday let. They have asked you to leave because you haven't indicated that you are leaving after your two weeks holiday. Have you given the impression that you would like to stay on after your two week holiday? If so then they have decided that you can't probably because another booking has come in.

    You can't turn something into a tenancy because it suits you. If you wanted a tenancy you should have found one through a letting agency. You are not going to find a tenancy on a website offering short term lets for holidays in BnBs.

    for all these details, there has to be a legal definition of a Bnb as opposed to a HMO for tax and compliance reasons etc. As well as being providing tenancy protection.

    I think you can only make that judgement with more info.

    Do they provide any services like room cleaning? Do you get a front door key? Does access to the common parts of the house get shut off at certain points (e.g. maybe there's a living room that's locked at 10pm every night by a housekeeper)?

    You may have a case that this is an AST over a single room in an HMO with rent payable weekly.

    I think to clasify as a BnB they have to be providing certain services. If you just have access to a room in a house and there's no cleaning/bedding/towel/meal services available then that's significantly more AST like.

    Holiday lets don't have to provide cleaning services, apart from the obvious one between lets. They don't have to provide anything, even bedding or breakfast.

    I can't see why OP would think he has any kind of tenancy on the information given. What he describes is no different to a few weeks self catering at Butlins!
  • After a quick look around the shelter website I wonder if you would be classed as an 'occupier with basic protection': http://england.shelter.org.uk/get_advice/sharing_and_subletting/occupiers_with_basic_protection

    On their tenancy checker if you say you live in a BnB it says if you have your own room, the LL doesn't live on the premises and you do not have any services provided you may be an occupier with basic protection.

    If you are this would indicate to evict LL requires proper written notice (a text message will not count) and minimum of a month's notice: http://england.shelter.org.uk/get_advice/eviction/eviction_of_private_tenants/eviction_of_occupiers_with_basic_protection

    Could be worth giving their helpline a ring.
  • The OP is just some a chancer seeing how he can get a few free weeks accommodation in a BnB or holiday let by throwing some red herring tenancy queries about to try and smokescreen the fact he's clearly not got a tenancy.

    He's already decided he's going to dictate the narrative of the thread around what he wants to happen rather than that will, so there's really no point trying to help him.

    AirBnB rentals often occupy a grey area. So I wouldn't say it's clear. I don't think the OP said they didn't want to pay the rent either.

    From what the OP is saying it may be LL has multiple residents staying longer term

    I guess the real test is does every occupant have a defined end time? If it's the case that some people stay and sometimes the LL allows them up to an extra month (paid directly not via AirBnB, which is what I take the OP's use of 'private' to mean) and then they're out then that's fairly holiday let like.

    If it's the case that you pay for your first couple of weeks via AirBnB then tell LL you'd like to stay and you just start paying regular rent until you tell the LL you're leaving that's less holiday let like.

    Rather than procrastinating over lease legalities i'd suggest the op's time would be better spent out finding alternative places to stay.

    The point is that there isn't any superficial difference between a furnished house let on a tenancy and a holiday cottage. Some holiday cottages are let on tenancies out of season but that doesn't mean that if you rent one for a holiday you can claim a tenancy when you come to have to leave.
