  • Thanks for your replies Folks..It does seem like I am talking to a brick wall corresponding with these fools..My Son Handles my correspondence, as I get very irrational and angry when these stupid letters arrive..I have told them I would pay it all back tomorrow ..If I could...I hate being in debt...And always had a good job with high salary , prior to my breakdown....It's a pride thing with me as well....I feel helpless at times....I have told them I am seeking advice..Via e mail...I wrote in the message that I "know you will ignore this e mail" just like you ignore every other attempt I have made ..And low and behold ..I got a response...Ring us to confirm your e mail address.....!!!.....

    PS...My son offered a final settlement figure to them years ago..They just said no....I am awaiting a SAR from RBS ..The loans were originally Lombard unsecured personal loans...Even RBS are dragging there feet over that...They say the needed evidence of my signature !!! ..They have those on the original loan agreements.....!!!..I have sent a certified passport copy signed by my Bank Manager....Not sure what the SAR will reveal...Will it show the exact amount that I now owe ?...Interest was supposedly frozen on the accounts years ago...And I have not seen any evidence of any being added on my annual statements from Idem....But I have read that they do add interest..Not sure how they would do that without it not appearing on any statements ? ..But I am still very green with all this stuff...

    I doubt they would be adding interest, and certainly not if it's not on the annual summary statement.

    They can't add further interest unless the original agreement allows them to do so.

    99% of all consumer credit agreements do not allow this.

    RE; RECENT SAR REQUEST....Had a call from RBS today..Asking me to ring them back to discuss the exact information I require from them...I could not have been more specific in my letter requesting info on both loan accounts..Including the acc numbers....They have been stalling ..And first asked for proof of my signature..Now they have it..This message.....They are stalling over something..Not sure if it's fear of a PPI claim (PPI on both accounts..But used it )...Or don't they have the specific info I want....If they don't have the info on the accounts..Including the original copies of my loan agreements...How do I stand with this Idem group..With regard to paying any money..Since they have not been able to supply a copy of my original account of one loan either to date..Something not right here...SUGGESTIONS please...

  • The latest twist in my never ending saga ...A letter has arrived at my wife's home showing a copy of my Subject access report request letter...Including a copy of the cheque I sent ...THIS LETTER HAS COME FROM IDEM SERVICING...(in this letter they state...unfortunately this address is not known to us...And before we respond to any request ( I made my request to RBS not Idem...)....

    I don't live at my wifes address...And had to send a cheque from our joint account to cover the SAR request from our old address..As this is the address the original loans were made from....
    They further state ...If you can send a copy of a utility bill to enable us to amend our records....We will be in a position to respond to you....
    This sounds complete nonsense to me....I made a SAR request to the Royal Bank of Scotland ..Not Idem servicing..I am in dispute with idem....As they cannot provide evidence of the original loan paperwork...

    Is this normal for a Bank to send copies of your letters to a DCA ...

    Sounds like another stalling tactic...I feel as though both parties are working hand in glove to frustrate my attempts at getting any information via my SAR request.....And in any event ..What would Idem want to respond to me about..Surely they should send any such letters to my sons address ...Which is where I reside...Not to an address "which is not known to them"....They appear to be sending copies of sensitive information through the post to "unknown addresses" ..Which is wrong in my opinion...

    They are very cagey on there website (idem) about what it is they actually do, if they buy bad debts, or just service clients accounts.

    The clue is they have a litigation debt, so that suggests they are a debt purchaser, if they dont own an account, they cant take legal action on it.

    My assumption is idem bought your old loan accounts, and have been trying to match there own records with the original banks records, and failed miserably.

    You can either choose to cooperate with them, and you should eventually get what you have asked for, or you ignore them for the fools that they are.

    Once again Sourcrates.Thanks for your input....I think the latter will apply...As they are indeed incompetent fools....It's surely down to RBS to engage in any further communications with me..As it it them who I have served the SAR on.....Idem are just kicking the ball into the long grass over this ...(as you say..They have not been able to come up with any proof of owning the debt..Or copy of the original loan paperwork)....

    If RBS have sold the debt, or are paying someone else to chase it I doubt they would do the work themselves. Why do work regarding a debt you no longer own or do wok that you are paying another company to do?
