Indigo parking fine - motorcycle in hatched area - rail car park

Hi all

I'm looking for some advice on a parking ticket issued to me today at Harpenden rail station.

The designated motorcycle parking bay was full as I had arrived late following a hospital appointment this morning. At the end of the designated bay is a small hatched area and following that a building. The hatching stops about 0.75m from the building so I have parked my motorcycle in this space, with no part on the hatched area at all.

In return I have a penalty notice from indigo stating I have breach code 03 offence-

Parked in an unauthorised/reserved/loading area.

This is in accordance with rail bye law 14 - to which I agree by entering the car park and be bound by terms and conditions etc etc

The fine is £100 reduced to £60 if paid in 14 days.

There was a sign displayed saying no parking in the area, however I was parked outside of the hatched area completely.

I had seen other bikes parked in this spot before so assumed it would be ok. I'm new to this area too so guess I shouldn't have assumed.

I have several photographs of my bike in this area.

I would be most grateful for any advice as even £60 seems somewhat unfair.

So far I have not appealed the ticket in anyway.

    Please read the Sticky thread for NEWBIES then send the BPA appeal template in blue that you will find there.
    If the ticket was attached to your vehicle today, don't send the appeal yet. The NEWBIES thread tells you why.
    Appeal as keeper, never identifying the driver, around day 25-26. You shouldn't say in your post who was driving, just mention The Driver and The Keeper.

    If you wish you could add that there is no such Byelaw breach code 03 offence as:-

    Parked in an unauthorised/reserved/loading area. A responsible parking company would know this and not talk borax unless they were scammers.

    Spend time reading the NEWBIES and don't rush this.

    The idea is to drag this out past 6 months when it becomes statute barred. Only the Train Operating Company can start court proceedings, and then only for trespass, and then only against the owner (not keeper or driver) and then only for six months under Byelaws.

    NOTE : when you have appealed and its dismissed , they will have to issue a popla code , popla have put all bylaw cases on hold

    take your time , 6 mrhs is the max time they have to start a bylaw case in court
