Selling on survey

Has anybody ever re-sold a survey they have paid for?

We pulled out of a purchase last month for reasons that weren't survey related (in the main). They have now found a new buyer. The EA has asked if we are prepared to sell on the survey to the new purchasers. Of course we'd like to recover some of the wasted expense so have said yes.

Assuming the new purchaser wants to buy our survey, am I right in thinking after I have been paid I will need to forward it to the new purchaser rather than the EA, as the survey will belong to the person who buys it from us? Otherwise potentially if they pull out, the EA would then have a copy of our survey which two lots of people have paid money for but they can pass to a 3rd potential purchaser free.

    If I were the other buyer I would not be interested in buying your survey from you, as I would have no contract with the surveyor, and would have no legal comeback if I later discovered that the surveyor had missed something. The contract would still be between you and the surveyor you instructed, and does not cover anyone who you subsequently sell the report to.

    If I were the other buyer I may contact the surveyor who carried out your survey and ask them to carry out a re-inspection of the property on my behalf, at a reduced rate, but I would not be interested in paying for a copy of your survey, as I would be missing out on the legal protection I need.

    You aren't selling a 'survey', you're selling a report of a survey.

    I wouldn't want a survey done by a stranger, for all I could know you could be a friend of the vendor trying to hide something

    There is no come back for me if there was something missing from the survey as it was you who bought the survey not me

    Well the request came from the EA, not us offering to sell it on, so the idea didn't come from us, we've no idea who the buyer is and didn't know it had re-sold.

    I appreciate your thoughts on whether you would trust a survey done for somebody else, but that wasn't what I was asking. If the new purchasers want to buy our survey report, do I send it to them or the EA?

    I wasn't suggesting the idea had come from you, merely pointing out why the other buyer may well decide to have their own survey carried out, rather than purchase your report.

    Yes of course the other buyer may well decide to have their own survey done, and I would if I was in this situation, but the EA has asked me if we're willing to sell the survey on, so they must think the buyer may be interested in doing so otherwise why bother asking us?

    You can tell them you are willingto sell the report. It would be up to whoever buys it to tell you where to send it.

    Tell the EA you are prepared to sell it, they can then communicate this information to the new buyer, then the EA can come back to you and let you know whether the new buyer is interested in purchasing the report from you. If suitable terms have been agreed presumably the EA can let you know where the new buyer would like you to send it.

    There was a clause on the back of a survey we had done on a house that stated we weren't allowed to sell our report onto anyone.
