Hello everyone, I'm a long time browser but first time poster.

I am just wondering if some of you knowledgeable folk could give the attached letter the once over for me please. I copied the basics from the Newbie thread so hopefully i have got things right.

To give you a bit of background on this, the wife, mother-in-law and my little girl went for a days shopping on the 1st of November to the Kingswood retail park in Hull, they were there for 3 1/2 hours. Fast forward to November 14th and the wife gets a Parking Charge Notice from G24 to say she stayed in the car park for 203 minutes and the limit is 180 ! Shock horror !!

Anyway I have been given the task of trying to sort this out, so, having browsed these forums numerous times this is the first place I came for some help and advice.

I have contacted some of the retailers but they aren't interested, they either told me to send receipts to G24 or in the case of Asda, said that G24 do not enforce their bit of the car park (but they will be doing soon)

As mentioned earlier, I have copied the below letter from the Newbies section, I intend to post it off to G24 along with copies of the receipts and then once that is done, basically dismiss any further correspondence from them.

Does this sound like the correct approach? I think, from what i have read that it is but i am just after a bit of guidance/reassurance/advice from those that are more in the know then myself.

Dear G24

Re PCN number: **********

I am not ignoring your charge for a purported parking infraction.

However, as the driver has not been identified, I require the following information so that I can make an informed decision:

1. Who is the party that is contracted with your company? I require their contact details and the full identity of the landowner.

2. Is your charge based on damages for breach of contract? Answer yes or no

3. If the charge is based on damages for breach of contract please provide your justification of this sum.

4. Is your charge based on an agreed 'fee' for the provision of parking? Answer yes or no. If so, please provide a valid VAT invoice for this 'service'.

5. Please provide a copy of the signs that you can evidence were on site and which you contend formed a contract with the driver on this occasion, as well as all photographs taken of this vehicle, including, entry, parked and exiting.

Do not send debt collector letters and do not add any costs which would be a thinly-veiled attempt at 'double recovery', specifically prohibited by the POFA 2012 Schedule 4. I will not respond to debt collectors and to involve a third party would be a failure to mitigate your costs as well as deliberate and knowing misuse of my data. For the avoidance of doubt, I do not consent to my data being shared or processed by you or your agents.

I contend you have failed to establish keeper liability. So, to continue to process my data now that you have exhausted your only DVLA-allowed purpose (i.e. to invite me to name the driver, which I decline outright) would be wholly unreasonable and contrary to the Data Protection principles. To share, sell, store or process my data at all now you are aware that you have no further excuse or reasonable cause, will be data misuse and I will report you to the Information Commissioner.

I deny liability for any sum at all and you should consider this letter a Section 10 Notice under the DPA. You are required to respond within 21 days.

Furthermore, in order to resolve the dispute I attach copies of the drivers receipts dated November 1st 2016 to prove that they were a genuine customer using the shopping facilities for the purposes intended.

    1. Do you have any receipts or proof of spend? If so, send to G24

    2. Does anyone know if there are ANPR cameras between the main and ASDA car parks? Could you not have parked in one part for some time and then moved to ASDA for your food shopping?????
  • Hi there Guys Dad, thanks for coming back to me.

    I do have some receipts which we intend to copy and send to G24. I mentioned in the last paragraph of my letter. Hopefully that will be enough to get these leeches off our back.

    According to the person I spoke to at Asda, she said we can swap between the two car parks, so 3 hours in one and the rest of the day in the Asda's. But as for the ANPR cameras, I aren't sure.

    The mother in law has some receipts too so I'm getting them later this evening as further evidence.

    Does anyone know if I wait the 28 days before posting my letter and receipts ? I read something about that but wasn't sure if it applied in this case?

    Hi Danny - My wife did the same thing at this site. Unfortunately I didnt take the correct approach like you are doing and have gone down the ignore it route.

    I have had 6 letters so far but havent heard anything for a while but I am interested in how your appeal goes.

    Hi there utigers. Hopefully they have given up on you and the wife. For me these parking companies are parasites, they literally trade on the basis of intimidation. I will keep this post updated, my original post has had a lot of views, no one has come along and said there's anything wrong with the letter so I will post it off in the next few days with copies of receipts.
  • Hi all - just wanted to update this thread, last week we received a letter from G24 parking, thanking us for the letter and copies of receipts, they advised that they would not be pursuing the cost of the ticket as they were satisfied that the wife was a genuine customer. Thanks to the people on this forum whom put the letter together at the top of this thread, i think it is worth sending a letter and copies of reciepts off just to stop these parasites hounding you with threatening letters and perhaps selling the "debt" on to debt recovery companies.
