got a notice from Parking eye and a fine.
i have a disabled badge and no disabled parking spots was available. which meant i was 30 minutes late and i got a PCN for parking eye.
I cant find the reciept for my shopping in asda.
whats the best way to appeal this.

Read through the newbies FAQ thread to get up to scratch on the game you are now involved in. Then at the appropriate time send the appeal set out in blue type.
Also contact asdA and ask them to get it cancelled - if you cannot show a receipt no matter. Point out your blue badge!0 -

go onto their website and place an online complaint with psn number and the fact that you are covered by the EA2010 as well as owning a valid and current blue badge
tell them they should cancel this forthwith due to EA2010 issues and to place your VRM on a global whitelist so that you never receive a parking ticket on any of their car parks from now on
dont take NO for an answer
I didnt take no for an answer, and they recently added MY vrm to the global whitelist, so it definitely can be done0 -
spoke to asda in store - they said just give parking eye a copy of your blue badge?0

by all means use the PE online appeals page and use the blue text BPA appeal from the newbies sticky thread and add a line stating that
an occupier of the car is a blue badge holder and proof has been attached
but you should still do what I told you to do , to get this one cancelled and to make head office in leeds aware that its a national problem, to get them to cancel it and to get them to add your VRM to the global whitelist as well , so that it never happens again
ie:- a two pronged attack , be proactive , dont get mad , get even , and come out the other side winning , like I did
ps:- the stores have not got a clue what is going on , I can assure you of that having spoken to their customer service desk , the assistant manager and the manager at my local asda0 -
here is an amended copy of my original online complaint made a few months ago (it took quite a while to get this resolved)
I have decided to ask in advance about the new parking arrangements at your (local store address) due to the changes from Smart Parking to Parking Eye (starting tomorrow) , one of the most aggressive parking companies in the UK who issue over 30 thousand court claims (MCOL,s) per annum , bear with me
I am a disabled person , who has a Blue Badge (not valid on private land) but who has a long term specified illness that means that I qualify under the EA2010
I (and my able bodied wife) have used the (local) store for over a decade without incident , but tomorrow (15th august) Parking Eye take over the parking duties there and I would like your thoughts , in writing , on how this may affect me as somebody who qualifies under the EA2010 (not as a Blue Badge holder, although I always use it anyway and try to use the disabled spaces , if available , or the car park itself if the disabled bays are full)
the previous signs said BLUE BADGE holders were welcome and the parking was free , no payment in any machine , no requirement to show a ticket in store , there were no parking rules AT ALL other than show your blue badge and clock in the windscreen area , which is commendable to both ASDA and SMART parking)
my able bodied wife would buy a ticket , display half in the car and redeem the other half in store so no problem there either, if shopping without me
she has told me about the new signage and Parking Eye regime starting tomorrow and as I am sure you are aware this has caused much concern due to their methods of hounding motorists who may be legitimate users of your store , plus the parking time has been reduced from 4 hours to 2 hours , which is ridiculous when you think of all the facilities you have there , including a cafe , opticians , large grocery and clothing store etc , yet Morrissons (local store address) is free parking for as long as you like and closer to us too , so no fear of silly Parking Charge Notices (invoices to you and me , "fines" to most people)
please dont give me a stock answer about car park turnover, both car parks are huge and you have had no problems over the last few months when no parking company operated there , please dont give me the Parking Eye party line either , its all smoke and mirrors and I am fully aware of the real issues here
Parking Eye make money from targeting your customers for up to £100 bills (invoices) for being on the white line , or overstaying , being their biggest money earner and they take people to court and try to get a CCJ judgment (like they did with the well publicised Barry Beavis case last year) - he overstayed on a free for 2 hours car park in Chelmsford due to Staples having a broken machine and he was waiting for an order to be fulfilled . I dont want a £100 invoice for using your cafe and then doing my shopping and taking 2 hours 30 minutes due to being disabled , or a court case either
you are under a legal obligation to make reasonable adjustments for disabled people , WHICH YOU DID PREVIOUSLY , under the SMART parking regime , so what concessions do you give me now that SMART have lost the contract , which I am sure you would accept is the same as before , because that concession meant that ASDA fully met the EA2010
so perhaps you can give me assurances (not platitudes and not the usual cut and paste excuses about car park management) regarding this change and also what , if any , leeway you give people like me under the EA2010 where you demonstrate that you have made "reasonable adjustments" under the EA2010 for people like myself , including clarification on what I do if all the disabled bays are full (which they tend to be at peak times)
my family have already had run-ins with Parking Eye over an overstay at the local retail park in Tameside (free parking for 4 hours and no return in 2 hours) and dont want a repeat of that sorry saga I can assure you (where hundreds of pounds was paid to various retailers on that large site), it was a consequence of this saga that I am now fully aware about the parking issues that have arisen in england and wales since POFA2012 arrived and especially since Barry Beavis lost his case to 3 courts and 11 judges last year
IF YOU ARE NOT SURE OF YOUR RESPONSE, PLEASE CHECK WITH YOUR CEO , or his office team , as I am sure he gets hundreds of complaints over these issues and will have done for years
thank you for reading and I await your response before daring to frequent your (local) store again , because the last thing I need is to be writing to your CEO just to get an unfair parking charge cancelled, plus I definitely do not want to be taking ASDA to court for discrimination under the EA2010 as a counter measure (counter claim) to an unfair and unjust Parking Eye invoice after using your store or stores in the future
please note that my protections under the EA2010 supercede any Parking Eye contract you have signed and the fact that I qualify under the ACT means I do not have to show any badges at all, but I will continue to do so once I know the concessions that you (ASDA) offer me , as a disabled person

especially change it to reflect the fact that you have a pcn and give the PE pcn number too , plus your VRM as well (the one listed on the pcn)
also note that some of the experiences above are personal and local and your locality may have different rules , different timings etc
I expected as a bare minimum to get the usual 3 hours that people receive with blue badges , or the same as previously with SMART which was no time limits at all , however they offered to place my VRM on their global whitelist, stating that I would never receive a parking charge notice at any of their stores (so no time limits)
meanwhile , PE told them that they do not issue charges to vehicles with a BB (yeah right) - I could not get that in writing however , it was verbal only (probably V.D. if you ask me)
this was what I received from the local managers office (including the IAN HISLOP faux pas and also the typos too, lolRegarding your enquiery about your blue badge. As long as your badge is in date there should be no issues on you carrying on using your badge on our carparks.
I have spoke to the company who run private eye and they have no issues with this as long as the badge is in date and displayed accuratley.

Dear Parking Eye,
I am a disabled driver and on the day in question, there were no disabled parking spaces available. Clearly some of them were being used by able-bodied shoppers too lazy to use spaces provided for them. I drove round and round looking for a BB space but after some time, I was unable to find an unoccupied one and was obliged to park some distance from the store when I was able to find a space with sufficient room to open my door.
I note that the BPA Code of Practice states the following
"16.4 You are at risk of a claim under the Equality Act if you do
not discourage abuse of the ‘disabled’ spaces. This means
that you need to make sure the spaces are regularly
checked to be sure they are not being used by people
who do not have a disability. "
Can you confirm your company's procedures for regularly checking the disabled spaces as required by your Trade Association? I believe that it is entirely as a result of your failure to have such procedures in place that have resulted in me having to spend over the allotted time in the car park.0
