I'd use that to complain to the DVLA - They've essentially admitted they have no case or reason to have requested the data.

The DVLA use number of complaints as a measure of who to investigate so get the complain in. The more "mistakes" the more likely the DVLA will come down on them.

Before you do this though, you could even ask for compensation from Gemini - on this occasion only - for the distress their letter has caused.

If they decline, then send off the complaint.
