I'd use that to complain to the DVLA - They've essentially admitted they have no case or reason to have requested the data. I mean, they haven't said it was a good will gesture, just that they cancelled it after consideration of your appeal.0 -
Exactly. Fire a complaint off to David Dunford at the DVLA data assurance team.
Point out to them that, while you accept that automated systems might make mistakes and misread reg nos via. ANPR, this is why the IAS COP *REQUIRES* there to be suitable and sufficient manual checking to be in place to ensure personal data is not incorrectly requested. If the ANPR image is sufficiently unreadable that it can be mistaken for a different vehicle, then the manual checks should either:
a) identify the error and subsequently identify the correct vehicle;
or
b) deem the plate unreadable and dismiss the charge before they do so much as print a letter.
What they SHOULD NOT DO is try it on by just sending NtKs out to the "best guess" or "closest match" reg number in the hope that the poor mug on the other end pays up regardless.
You'll get some response saying that in this case the appeals process has proven adequate such that the charge has been cancelled.
Don't fall for it - that isn't the point. The point is that your data should never have been accessed in the first place.
I also note that the cancellation does not - as EXPRESSLY REQUIRED - confirm that your personal details have now been deleted. I'd be tempted to respond and insist on that clarification, reminding them that if you don't get said confirmation inside the remaining 6 days from the original date, you'll take it up with the DVLA and the ICO.
You might also want to write to your MP using a modified version of the BMPA template letter outlining your case, and pointing out that the claimed "99% accuracy" of ANPR is clearly misleading etc. etc. etc.0
