  • Hi guys still no outcome yet, my appeal is at stage 2 of 4.. How long roughly does this normally take?

    Also is had a debt collecters letter demanding £160. Shall I just ignore?

    POPLA takes roughly 4-6 weeks (depends on traffic). Importantly though, there should be no one chasing you for payment while you are going through the appeals stages.

    Ignore DRP, but you must send a very strong complaint to both the BPA and DVLA that Smart have set their (toothless) dogs on you when the case is nowhere near decided.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    to complain that this parking firm are sending debt letters while a case is at POPLA. Send evidence (the letters and the POPLA email confirmation or screenshot of the Portal proving it's underway).

  • Hi guys, I've just tracked my case on the popla website and its saying it's been withdrawn at stage two. Can anyone clarify what this means and if I shall receive any formal notification that it's been withdrawn?

    Hi everyone

    Really new to this and very stressed had a smart parking fine for using Matalan store for 15 mins whilst my partner waited in the car and I went in to collect a click and collect order and bought other goods as well, it was a Sunday evening raining and dark and the store was almost closed really didn't realize I had to put my reg number in and get a ticket, spoke to the store and they said appeal which I did and they declined it and sent me a popla, I have put the appeal in with popla and enclosed a copy of my receipt spent in store, am waiting a reply, the fine has now gone up as it's been 14 days, spoke to Matalan again and they said to email smart parking and ask if Matalan can request the fine to be cancelled, should we just pay it, have never challenged a fine before like this. Worried about court, more fees and credit rating!!! Thanks

    Now it's all over, did you know you can now sue them for, say £250 for a DPA breach by virtue of them sharing your DVLA-obtained data against the rules (the case was at POPLA, they were not allowed to send your data to a debt collector):

    Compensation for distress and harassment caused
    by Smart Parking's misuse of personal information
    obtained from the DVLA contrary to the principles
    of the Data Protection Act (DPA) 1998. Specifically,
    Smart Parking processed and shared my data with
    a debt collector whilst the matter was under POPLA appeal,
    which is a specific breach of the British Parking Association
    Code of Practice and therefore a KADOE breach by the data controller.
