Basically I visited fistral beach on the stated date. I was driving and my girlfriend passenger we entered at *** according to the picture on my pcn which I belive is correct.. When entering we got held up due to mass traffic and lack of spaces. We then parked. And decided we was going to go for a walk along the beach after staying in my car a few mins I saw a car move from a spot closer to the beach so I quickly moved my car into that spot. I then walked to the ticket machine to see how much it was to park. I went back to my car got my wallet and back to the machine. I then had to wait a few mins as there was people in front of me taking ages! Eventually I got my ticket which I still have and I had attached it to my first appeal to smart parking because it clearly states I left there property before my ticket ended.

My ticket was valid until ***. And I left at *** which is stated on the exit picture on my pcn.
    Please advise

I am going to ask you for those timings though! It will help us decide about the Grace Periods argument.

    we entered at ***

My ticket was valid until ***

    And I left at ***

    Three timings please.

OK so 18 mins including driving in, searching for a space, moving the car, locking the car, reading the tariff, getting your wallet, re-locking the car and then queuing for several minutes then paying, in good faith. You then relied upon the timings on the printed ticket, which is perfectly reasonable conduct for you as the driver.

If Smart believed that your time was up by 15.24 then the ticket should have said that. After all they have the data of your VRN at the point outside, so they could/should print tickets calculated from the arrival if that's the time you are to be bound by!

Unreasonable crap, the usual pretence that the time starts secretly out on the road. Yep, if you look, is the first photo next to the double yellow on the public highway? Not inside the car park at all? Smart start the clock when a car is on street at Fistral! = another appeal point.

Okay I shall remove the gpeol,

.. So although I haven't said I was driving Iv addmited that I was clearly in the car. But who's to say I was the passenger? please advise

    Thanks.

Agreed, but you have to persuade a biased PoPLA adjudicator. So, in your PoPLA appeal you need to say you were an occupant of your car but there should be no assumption that you were driving, assuming you have not admitted it anywhere else. ;)This needs your immediate attention even though you were told about it 3/4 of an hour ago.

yes the first photo is on the road with the double yellows in the picture, and no not inside the car park at all.
