Motability car hand-back question.

    9 years of DLA HRM and HRC, and I got ZERO points with ATOS who lied throughout my medical report. I submitted 76 pieces of medical evidence dated within last 2 years.

    MR decsion didn't change anything. Now awaiting Tribunal date.

    Reported HP via ATOS, they have now been suspended pending an investigation, also logged complaint with HCPC.

    What the HP from ATOS didn't know was that I recorded him... and I have used evidence from a Dashcam of me walking into the building aided, when he said I was unaided!

    If you can get some help from Cab or similar with MR and concentrate on why you should get the extra points.

    Aren't you supposed to tell them that you're going to be recording your assessment and give a copy to them before you leave?

    I'm so sorry to hear this Missy :( Remember you only have 28 days from the date on the letter to get your MR in so be quick. Also make sure you put it in writing. Most MR decisions don't change so you'll most likely have to take it to tribunal. Could be a long process. It's very sad that about 500 motability cars are being returned weekly. The criteria for PIP Enhanced mobility is 20 metres or less but for DLA it was 50 metres or less. Quite a difference, which means lots of people lost their cars :( Please don't give up and i wish you the very best of luck. Please let us know how you get on. xx

    I have phoned up for my assessment report. I am not going to wait for it though as I have heard that it could take longer to come than the 28 days I have to do an MR.

    I have already begun a letter for MR. Hoping to get it sent within the next couple of days.

    The 'decision maker' (if that's what their called), said that she understood that I had great difficulty walking and was sympathetic to the pain and unsteadiness I get, but because I can hold on to my husband and use a walking stick when I do it, then that's ok.

    9 years? How can someone score no points after 9 years of full rate DLA?
    It makes no sense.

    I am not surprised that the MR didn't change anything. I haven't read anywhere about anyone being awarded more points after they had done it. I guess it's just the path we have to walk to get to tribunal.

    Remember to point out the reasons why you think you should have got 12 points. Also don't forget that if you can't do something repeatedly, reliably, in a timely manner, without pain and discomfort then that descriptor applies or should apply to you.

    Possibly because ATOS are not fit for purpose. In those 9 years I have been reviewed 3 times for DLA and it was after the second review I was put into the HRC group due to complex mental health problems. I'll be honest given PIP and DLA are different I didn't expect to get the same rates with PIP, I expected Standard on both rates, so to get ZERO points did kind of shock me until I read the ATOS medical report.


    I didn't use my HRM to fund a car, so the loss of PIP has not really bothered me, although I have had to cancel my private psych appointments which I funded each month and my podiatrist who I also saw once a month.


    I've lost £200 a month, but I did apply for a Discretionary Housing Payment to help fund my bedroom tax each week as I live in a 2 bed room flat, so I was awarded that until mid February with the hope the Tribunal will have happened by them, or I will have moved to another place since I am planning on moving into with my Dad, we are just waiting to be approved for the housing list elsewhere as joint tenants!
