To a point. As the seller has said the item is "out of stock or damaged" then it would be difficult to get him to fulfill that deal. As far as I know there is a route to pursue for "loss of bargain" which is essentially the difference between how much the item is readily available for and the price you've paid.
No one can force someone to sell something they don't have, the law isn't that daft.

Ordinary people could easily understand if it is a genuine mistake. The problem here is that how could you differentiate between a genuine error or just a making up excuse, because he changes his mind or he thinks he sell it too cheap and do not want to accept that. They forgot that eBay it is an auction where people could win sometimes but you could also loose. Is the thing like this not the nature of auction instead of buying it now ???

True. But is it not the seller duty to check to ensure what he puts in the auction is correct and true reflection of the item ????

I fully believe, professional lawyer who want to make a fuzz could easily see this as a nice lawsuit aiming for big compensation for damage, time, especially if it is a very high value item. They could come up with a list for damage caused by this cancellation, wasting their professional times, etc.

If you won the item at a bargain price, why didn't you just collect and pay cash?
