    I used to do the same mileage and got complaints from my mechanic about the state of my fuel filter.

    My neighbour only used the same supermarket for years and had to spend thousands to sort his Jag out with bad fuel related issues.

    Have you seen some of the dodgy looking tankers that bring the fuel to their stations?

    I've seen dodgy looking tankers delivering fuel to branded fuel stations too.

    The issue here is that trading standards generally have one officer per city and are not capable of fulfilling their duties. Even where they do detect an issue, fines are miniscule and provide little incentive for businesses to abide by the law.

    Define a "dodgy looking tanker" and how is that an indication of the quality and source of fuel it contains?

    Old and rusty on the outside, who knows what it's like on the inside.

    Years ago it was good policy to buy the most expensive oil and the cheapest fuel. That's not a good idea with modern vehicles.

    Of course you are all free to run your cars on what you like but personally I usually use Shell.

  • The difficulty with a claim like this is proving it. Of course if you can prove that the fuel was defective than you should go ahead and launch a small claim, it is easy to do.

    You should bear in mind that a lab test you arranged independently may not be admissible as evidence. In small claims track (i.e. claims below £10k), expert evidence (such as a mechanic's report) is not admissible unless the court has given permission for you to use that evidence, and the expert chosen to do the fuel testing would normally be jointly appointed by both the claimant and defendant.

    I agree that the Op's contract is with Sainsburys.

    However, it is possible to claim directly against a supplier if you can prove that they supplied a defective product. This would be a claim under the Consumer Protection Act 1987, which imposes strict liability for suppliers of defective products. See http://www.legislation.gov.uk/ukpga/1987/43/section/2.

    The Op could if he/she wished bring a claim against Sainsburys (on the basis of breach of contract) and against the supplier (on the basis of the Consumer Protection Act 1987) in the same case.

    The only "dodgy" fuel I've ever had was from Shell. Many years ago they introduced Formula Shell, a new petrol with additives to keep your engine clean. It was terrible stuff - wrecked older engines.

    I was lucky - I realised pretty quickly how badly my old Ford Escort was running on it, took the car to another petrol station and brimmed the tank (not something you usually do as a student). the car survived.
    If it sticks, force it.
    If it breaks, well it wasn't working right anyway.
