Contaminated Diesel Legal action.

Bought bad diesel from Sainsbury's despite having a lab test they refused my claim, Stating no one else had come forward, (we know of at least two people that don't want the hassle)
and they did not know diesel we had tested had come from them.

I plan on taking legal action. on the Isle of Wight all petrol stations use the same supplier. Isle of Wight Fuels, Can ask them to pay up fully expecting them to reject it and then.

make a claim against Sainsbury's and the Supplier in the small Claims Court.
Its hard to know if its Sainsbury's Tanks or the Diesel that was delivered to Sainsbury's that caused the contaminaton . By doing it this way. We hope that there is added pressure on the company that is really responsible.

  • In terms of Goods there have been cases where the Supplier has been taken to court for Faulty Items. even though the contract is with the retailer.

    What is bad diesel ??
    Do you have independent evidence of this bad fuel ??

    In your case Sainsburys, and them alone, are classed as the supplier.

    If your sole reason for taking them to the Small Claims court is to put put pressure on them hoping they'll just fold over and give you a remedy out of court I'd be very careful if I were you that they just turn around and call your bluff, particularly as you "evidence" is less than conclusive.

    You need proof, the fact you alone are complaining when they sell to thousands of customers gives you a snowball chance in hell.
  • Same advice as your other thread.

    1 complaint out of xxxx amount of customers that purchased the same diesel = not looking likely.

    Plus, the diesel you tested could have been contaminated by you - ie, putting petrol into your tank after filling up etc

    Personally, I'd be putting my time, money and blood pressure to far more profitable use.

    You have no proof your problem was caused by Sainsbury's.
    Even if you did, you have no proof their problem was caused by IoW fuels.
    Even if you did, you have no contract with IoW fuels.

    You also have the balance of probability against you, unless there are many many other people experiencing the same problems. How many people buy diesel at that supermarket per hour?

    Every batch of fuel is tested to ensure that it meets British and European standards. No doubt they will produce this as evidence to dispute OPs claim.

    I stopped buying supermarket fuel years ago, too many complaints from people.
