Just for reference, the letter I received recently is as follows:

We acknowledge receipt of your letter dated xxxx

We confirm that our client does not intend to rely upon The Protection of Freedom Act 2012. We therefore do not accept your assertion that you are not liable for the PCN.

Accordingly we will not be removing your details from our database and we will now seek our client's instructions to issue Court proceedings.

We trust this clarifies our client's position

    And that's it.

BWLegal are still in "dreamers mode"

You do not accept the assertion of EXCEL that you are liable.

Complain directly to the SRA and as coupon-mad says, the ICO as well.

BWLegal seem to be under the impression they are god when in reality they are simple thugs.

The 2016 version of the Kray Twins and the SRA do not want thugs as members .... do they ???

I've made the changes to my next letter as suggested on here, thanks so much.
I'm going to wait until next week to send it though to eek out a few more days.

I will be submitting a complaint to the SRA and CSA but I'm going to hold off on the ICO as this letter asks them one more time to comply so I'll make that complaint if they don't. Which we all know they won't.

Hi, do not accept anything with this lot.

You should make BWLegal aware that you are issuing a complaint to the SRA and you require a reply from the SRA before you correspond further

That's a good idea, it'll help add a few more days or even weeks. Although I doubt that the courts would wait on the SRA if a court case was requested. Worth a shot though

They are saying they will now seek our client's instructions

It's a fair way off court right now.

Look at it like a game of chess and make the right moves.

An immediate complaint to the SRA about the poor conduct of this firm is required

We know that BWLegal will ignore your letter again and that will prove that they have no interest in complying with the principals they must abide by with the SRA.

Should this happen, then a more severe letter to the SRA is required.

Right now, their client must instruct them. Then they should give a final warning before court .... then come back here

You treat sh*t with sh*t ... it's the only way to deal with this type of company

The response to BW Legal and a complaint to the SRA have been sent.
I haven't done the CSA letter yet as I'm unsure exactly what has been done wrong with regards to them. I can't seem to find any example letters that might point me in the right direction either. Can someone explain what is wrong with regards to the CSA?

I've got one of these letters too, but I've also got a follow up letter confirming that Excel did not send a Notice to Keeper, but they still intend to pursue me/my company. I have this in writing, on their letterheaded paper...

I've done my bit reminding them of their obligations under POFA, but I'm quite happy to run this through to court.

The clowns couldn't run a bath, let alone a litigation business.

I don't even have to worry about PoFA as the ticket was for around 18 months prior to that. But they still think they have a case even though they have no proof who the driver was

Quick update. After sending in my last letter I got a reply today, only 3 days after I sent the letter. It states that they are sorry I feel the need to complain as they endeavour to ensure their "client's customers" are dealt with fairly and in a professional manner.
    So we are customers now.
And also enclosed is a copy of their complaints procedure which says they hope to respond in 4 weeks and resolve in 8 weeks
