Have I stuffed myself - Yes or No?

I've read the "newbies read this first" thread but a little later that I should've I think.

I stopped at the Mallard Harvester in Hemel from 11.38 to 11.54 on 18/08 and received a notice (dated 27/10) last week. I stopped as I was on the way to a meeting and was feeling really unwell and this was the safest place to stop. I pulled over and stopped in a bay for 15 minutes before setting off again. I didn't leave the car and the engine was running.

Received the notice and sent of an appeal before reading anything here (I know I know)! I basically said I was the driver and the reason for stopping. They turned my appeal down flat in an about an hour.

I contacted the Harvester chain and the regional manager said nothing he could do to help. I'm guessing the answer but appreciate a YES or a NO from those better placed and educated in all of this than me!

You need to tell us who the PPC is.

Yes/No polls are daft! Worse than Trump/Clinton. :rotfl:
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Get rid of the poll, it is useless and distracting. Mitigation/what happened on the day won't work with a parking company unfortunately. If the vehicle was stopped, you were parked, irrespective of whether you were in it or the engine was running.

Please read the Sticky thread for NEWBIES then appeal using the appropriate template you will find there. We can't tell you which template because you haven't told us the name of the PPC.
Unfortunately you have given away a valuable appeal point if you have said who was driving, but all is not lost. Just follow the advice in the NEWBIES.

I suspect that the pub employs a PPC to prevent railway passengers abusing the parking, but your case is different.

AFAICS, you had no choice, stop until you recover, or continue to drive on with perhaps fatal consequences.

If they were daft enough to take you to court, it is most likely that a judge would find for you so, on no account pay them, unless you are one of those people who want to avoid conflict at any cost.

They are scammers, I am sure that a Council would let you off, especially if you had a history of such lapses, so make them pay for their greed and lack of humanity.
You never know how far you can go until you go too far.

I know you didn't eat there but reviews mention "Absolute Parking Management" as the operator.

The manager was telling you a lie when he said nothing that can be done. They took on the old to attract as their agents, they are jointly liable for the actions of their agents.

I can't get rid of the poll for some reason!

It's APM (Absolute Parking Management Ltd)

As per my post, I've already appealed.

Yes assumed that. I tweeted about business being bad for Harvester when they have to charge a rate of £240 / hour for parking. They responded to that and then I was contacted by a regional manager.

OK thanks for that. And yes, it's right next to a station car park, so I imagine they did have commuters parking there all day.
  • Is THIS the place?

Sadly, the Google Maps picture is from 2012 so not much help.

What "contravention" have the PPC alleged? Doesn't look like a pay and display car park, so what are they claiming you've done? Presume this was a postal NtK via ANPR cameras?
