Landlord trying to stop me any overnight guests under any circumstances

  • Quick update everyone! So I just got off the phone to the lettings agency, and they confirmed that I am in fact a tenant, not a lodger, and I have a tenancy agreement.
    They also told me that they would not have told him that no overnight guests were allowed, which is what he claimed they told him. (Clearly the language barrier has not worked in his favour and he should have tried to understand it more clearly)
    Unfortunately even though they are willing to help and advise me, it's not their prerogative to give him a call and intervene as their work is done regarding the house. However the lovely woman told me that she is more than willing to explain this to him and I should point in her direction to do so.
    Looks like I need an 'I told you so' chat with him in the least smug way possible. Hopefully he'll ring them up and accept that he can't have this rule and begin to cooperate.

    Is your bedroom next to his (LL) perhaps you and your girlfriend are too noisy and that's why he has told you your girlfriend can't stay and not the other tenant.

    Doesn't change the fact that he doesn't want your g/f there; I wouldn't be able to relax if I were her. Sometimes it's about more than the law.

    The agent is not the arbiter of the law. It may be their opinion that you are a tenant but that does not make you one any more than if it is your opinion, my opinion, or uncle tom cobbly's opinion.

    They may or may not be right - only a court could say for sure.

    The landlord has no obligation to accept the agent's opinion (though of course he may do).

    You also say "their work is done" so I asume they were employed to find..... errr.... tenants.... or whatever, but not to manage the .... errr.... tenancy.... or whatever it is. This makes their 'opinion' even more moot since they have no involvement with the contract at all.

    The landlord may speak to the agents, and may listen to/accept what they say.

    Or he may not speak to them (why should he?), or may speak to them but disagree with what they say.

    So count your chickens after they hatch - not before!

    And I still recommend you negotiate to move to a property where disagreement such as this does not arise.

    The landlord didn't move in after the OP's "tenancy" started though.

    When I viewed the house, all three rooms were available, and me and another boy signed for two of those rooms, then a month later when I moved in and signed the contract when I picked up the keys from the letting agency, the letting agency told me another agency had let the room out to someone, I got there and he was living there in the third room. We were under the impression he was living there applying finishing touches before everyone moved in.
    Therefore I signed under the impression that I was a normal tenant, but does this mean nothing if he was there from the start of me living there?

    The landlord moved in before any supposed tenancy started.

    I'm with G_M on this one. The letting agent's word is not law. Letting agents do not require any specific training or qualifications so any eejit can set up as one. I would check with Shelter before you start celebrating.
