Unfit to drive - Recieved parking charge

Hi all,

Been reading the forums here and looking for some advice/reassurance that i'm doing the right thing.

Recieved some 'toilet paper' from Vehicle Control Services Ltd. (VCS) and made an appeal, this was turned down. Made a second appeal to the Independant Appeals Service (IAS) which has now also been turned down. I have not yet heard back from VCS but I believe they want £100 out of me from this point. I also admitted to being the driver as I believe this charge has no grounds in civil or legal matters.

IAS dismissed my appeal to them on the basis that the charge was properly served - i find this hard to believe.

My case is that I took ill whilst driving causing myself to stop on a roundabout and then pull in to a road and park on double yellows to await for familiy to come to my aid. I had to wait here for an hour anda half and was in the vehicle the entire time and in no fit state to drive.

To my knowledge this breaches their contract under mitigating circumstances..

Does anybody with experience have any further thoughts?

  • After reading here I realise I may have made a minor error in making an appeal and admitting to being the driver of the vehicle in the first place. Though I took this approach as I believe there to be no standing for the notice whatsoever.

    It wasn't even a window ticket.. it was one of those vans that drive around with a camera on top!

    and does the docks not come under land that cannot be deemed to be aplicable ie: under bylaws ,

    1st exit of the roundabout onto Princes Parade but before the T-junction onto William Jessop Way. Elegedly I would have passed one sign, but was very sick and was not looking for signs.

    I'm not entirely sure what you are suggesting relating to 'under dock authority', it is a public access area but is privately owned.. are you suggesting I shouldn't have been there? - if so I think you have the wrong end of the stick.

    I even rang Merseyside Police who informed me so long as I wasn't on the roundabout it was safe to wait there - I had no idea the area was 'privately operated'.

    It is no longer a dock it is now a residential and business estate. Built around the old Princes and Clarence docks.

    It is owned by Peel holdings and infested by VCS. There are signs on every lamp post, but no large ones as you enter unlike the Airport.

    It gives a check list of the items that the PPC should send to the IAS e.g. pics of the signs at the entrance. Check to see if the PPC complied.
