If you took finance the finance company have to honour your warranty on section 75 of the CCA.

Hi we paid £900 deposit back in August and were due for fitting 1/12. I have got some more quotes that I am happy to go with. My worry is that if another company takes over betta living could still turn up with delivery. How can I ensure this order is cancelled and I'm not liable for it?0

Does anyone know where we stand if the administrators come back and say they will honour the orders but we just want out? I paid the deposit by credit card which the cc company ae now investigating and have cancelled the shawbrook direct debit. Is that allowed? I dont trust them at all and i have not received any goods.0

Freer, did you get a letter from Shawbrook saying they'd completed your loan and transferred the funds to Betta Living?
Mine came around a week before delivery of the kitchen.0 -
Hi Valley, yes I did get that letter on the 31st. I have not received any goods though and even if they go to administrators who want to fulfill orders, I don't trust them and would rather cancel, do you know if we can do that?0

I spoke to Shawbrook about cancelling and they sent this, is this right? isnt it breach of contract, they havent delivered the goods at the agreed time:
Unfortunately we cannot cancel at this present time without authority form the administrators as your contract is now outside of the cooling off period and is a contract the administrator may look to fulfil
We would expect them to make contact with customers so any reservations can be raised directly with them

What I would say though is your kitchen has been manufactured and exists somewhere, so if at some point it was delivered to you then it would be just a case of your fitter installing it, who knows how long that could take though.
I would be more concerned about asking Shawbrook where you stand on them transferring the money and you not receiving the goods. Matt mentioned in post 3 that Shawbrook don't transfer the funds until you've taken delivery but clearly in your case and mine they do. If the T&Cs state that shouldn't have happened then you need to take that up with them. I don't have my paperwork with me so can't check it.0 -
Ive just spoken to another kitchen company, who said that there would be a delivery note with the items stating that as we have taken delivery that the funds have now been transferred and that they should not have transferred the money before that. will be home in a bit and will go through t/cs .0

Hi Valley, the shawbrook terms and conditions, point 3, states:
we will advance the amount of credit once the supplier of the goods and services has delivered the goods and services to you.0 -
I'd be straight on the phone then asking them to cancel the contract0
