I'm not wanting to start a binfest here and in fact clarifying MSE's position, hopefully, so we all know not to quote an Assessor's name.

The uncomfortable part is that this suggests that someone may have complained to MSE that the Assessors' names (which are openly given to appellants, without caveat and are required to be published in POPLA Decisions) are...being published in a thread called 'POPLA Decisions'.

Hmmmm...whether this was raised or not by the BPA (could have been POPLA, who are provided by the BPA anyway or could have been MSE's own decision) bearing in mind the significant lobbying of the DCLG by both ATAs this year I seems a timely moment to link to Martin Cutts from the Plain Language Commission in this article:

    How odd, because the UK Government states in the Alternative Dispute Regulations 2015 that assessors must be identified. Why do MSE believe it is wrong to post information that is in the public domain, and is a requirement of the UK Government to be in the public domain?

    Absolutely ridiculous it is someone acting in a public capacity.

    If MSE want to avoid an allegation of double standards I hope they are going to remove the names from Discussion Time threads of the three High Court judges who handed down the Brexit related decision this week.

    This is ridiculous, just as County Court judges are named, so should adjudicators be. Anyone who thinks otherwise is not thinking straight.

    Again this is something in the public domain, by the same extent then other names also on the public domain should be edited out as they too would fall foul of this ridiculous poilicy here are a few examples, if these are not edited then there could be something fishy afoot

    The publishing of Assessors names is critical in looking at POPLA decisions and these names are freely available, by editing them out MSE is in effect making it harder or impossible to review and assess POPLA decisions.

    Another name is Rachel Ledson of Parking eye.
    Rachel Ledson, the head of Legal services at parking eye was responsible for this, according to the Parking prankster
    ParkingEye sue parent of seriously ill child


    ParkingEye have commenced action against the parent of a seriously ill child. As if the family do not have enough to worry about, they are being pursued for a substantial amount by the heartless money grabbers at ParkingEye.

    In this latest case, the child was diagnosed with a serious illness and was undergoing treatment. However, she can become unwell quickly and require emergency help. On the day in question this happened and she was rushed to hospital on the advice of her doctor. The driver remained with the child throughout as she was distressed and was unaware that the parking rules had been transgressed until a postal notice was sent.

    The hospital in question was Queens Hospital, Burton on Trent. This hospital has been previously reported as having misleading and confusing signage, plus a complex parking system designed to maximise income from transgressions.

    ParkingEye do not get paid to manage the site and their only income comes from motorists who inadvertently break the rules. To their credit and the delight of their investors, ParkingEye have managed to devise a wonderfully complicated scheme which is very easy to fall foul of and which allows them to trouser huge amounts of cash from vulnerable people. Although the system is unfit for purpose, and directly against government directives, the hospital have so far refused to replace the system with one which is fair to both the hospital and the motorist.

    The action was taken by the head of their legal services, Rachel Ledson, There have been a number of complaints to the Solicitor Regulator Association about Ms Ledson regarding her predatory tactics, She has been known to provide false information to the courts and incorrectly redact information in her quest to win at all costs. In addition, she often tries to mislead the court that documents cannot be provided as they are 'commercially sensitive' when they have already been made available elsewhere through Freedom of Information requests.

    It seems to be a forum wide issue. Posters on other parts of MSE have been told not to publish information such as directors of companies names.

    I can see some grounds for removal of names when the motive is clearly vindictive, but that is not the case here where knowing if particularly perverse adjudications are coming from the same assessor can be key to an individual or individuals challenging the outcome of their POPLA appeal.

    Whether we like it or not, I would suggest we follow the MSE rules.

    In my view the impact the forum makes on the PPC business model is so significant that they will try any and everything to shut up such a valuable resource.

    It will only take a few complaints by PPC stooges about breaking this rule for someone to be PPR'd. Much better to just abide by it and keep costing the PPC's money.

    Yes it is important we maintain this resource.

    There are certainly some companies (BPA and/or IPC members) who see this forum as impacting on them and who would like to see regulars PPR'd. So we do need not to be drawn about any MSE rules or any poster appearing to be on the wind-up.

    I started this thread as information for us all really.

    Has EVERY POPLA Decisions post where an assessor has been named, been edited? The answer is NO. In fact there's an assessor named in a post very close to the MSE Admin's post. ;)
