(Urgent!)Parking charge in luton airport (drop off in undesignated area)

Hi everyone on the 4th of october when going to pick up my nan we were confused with the new lay out of luton so decided to stop by the roundabout so i can jump out and find her. After stopping and my dad driving awayi realised theres a cctv car with a worker inside and the camera 3meters Above it. Obviously knowing we couldnt do anything we were expecting a letter but nothing arrived till the 1st of november when we recived a PCN issued on the 31/10 with a £100 fine for a 4 second atop. Ive read through a lot of the apcoa post but not actually certain what to do any help greatly appreciated

    Initial appeal (blue text) from NEWBIES FAQ sticky within the deadline shown on the APCOA Notice to Keeper. Use it as is, no changes or additions.

    Wait for rejection with a POPLA code from them. You can win this at POPLA. Read up plenty while waiting for APCOA response - they have 35 days to respond.

    Do forum search on 'not relevant land' to understand the issues APCOA face in pursuing the keeper. Do not indicate to them who the driver was - especially important in an airport case.

    Adjournment of cases involving Byelaws

    POPLA has decided to adjourn all cases on which the parking operator has asked the motorist to make a payment in respect of alleged breach of Byelaws. This is following complaints to POPLA and ISPA that POPLA has no authority to look at these appeals. We are considering our position and will make a further statement in due course. We do not anticipate the cases to be adjourned for more than two months from 1 September 2016. Parking operators should not pursue payment while the cases are adjourned. During this period, motorists must still submit their appeal within 28 days of the date of the POPLA code if they want POPLA to consider their appeal. If you have already submitted your appeal you do not need to take further action.
    1 November 2016 update
    It has taken longer than anticipated to reach our decision on whether POPLA has the authority to look at appeals in respect of alleged breach of Byelaws. We expect to communicate our decision within the next four weeks. Thank you for your continued patience while consider our position. In the meantime, our guidance remains unchanged: Parking operators should not pursue payment while the cases are adjourned. During this period, motorists must still submit their appeal within 28 days of the date of the POPLA code if they want POPLA to consider their appeal. If you have already submitted your appeal you do not need to take further action.




    get a popla code from them and appeal sit back and await , POPLa will either allow of disallow bylaw cases , either way 6mths is the limit for the landowner to start court action

    Your main point of appeal is that under POFA, they have only 14 days to deliver the NtK/PCN. They failed.

    That means that keeper liability can not be enforced, irrespective of Byelaws or not.

    They have to chase the driver for the charge and you are not going to tell them who that was, are you??????????

    The idea is to drag this out past 6 months, so do as advised plus send the BPA appeal template in blue from the NEWBIES thread as late as possible without missing the 28 day appeal deadline.

    Do the same with the PoPLA appeal, send it as late as possible. Make sure you put BYELAW Appeal in the title so it gets put on the stayed pile at PoPLA.

    It's not urgent. You have 28 days and this is VERY easy for a registered keeper to beat, simply by using the forum template first appeal (in the NEWBIES thread) and then later, copying from the most recent APCOA Airport POPLA appeal you can find.

    One of the easiest types of PCN, impossible to muck up as long as the registered keeper appeals using the template then copies a decent APCOA Airport example POPLA appeal.

  • It happen on the 4th of October so it is past 28 days and theyre saying they've already sent a letter but we haven received anything ?? ive been reading all these posts for like a week now but I just gonna send the template and wait . ill inform on the outcome . I know theyre just scum trying to rip of people but the laws usually on there side sadly

  • they don't actually have an appeal address on they're website( they got 5 emails but all for different counties and Ireland ????) and they don't provide anything in the letter ??

    If it is a PCN or 'Notice to Keeper' (not a 'reminder') then yes it does tell you how to challenge.
