Issues with Aster Living

Hi, my MIL moved into a council property in 2005 and the place was carpeted (when it was owned by the council).

Since that time, the landlord has changed twice and is now Aster Living. They are now demanding that the carpets are removed as she has moved into a residential home as this condition forms part of their tenancy agreements.

She has never signed an agreement with Aster and there have been no amendments to the original agreement. I have contested this with the Housing Association as I do no believe we should have to remove carpets that she did not install (that were the property of the local council).

Has anyone else been in this situation?

    So she is no longer living in the (ex) council property? Who is living there now? You? On what basis?

    The carpets were supplied by the council at the time she moved in.

    She holds the tenancy until the end of the month so we have to clear it out as she has moved in to a residential home.

    Her original tenancy agreement with the council applies.
    The fact that there have been no amendments to the original agreement is irrelevant.

    What matters is what the original agreement says. Can you quote any relevant part for us please? It is quite common with council tenancies for a departing tenant to have to empty a property. It is also common for council properties to be supplied totally empty (with a requirement for them to returned likewise). The council may have provided the carpets originally but this may have been a separate agreement eg a gesture of goodwill or a seperate Benefits claim.

    As advised, read the original agreement.

    The original agreement states that the property must be empty of all personal belongings and rubbish which it will be. The new Aster agreements (and the instruction from them in a standard form) state that carpets should be removed which is not stated in the original tenancy agreement (it is on the new Aster agreements on their websites)

    Seems a bit premature until they actually charge you.
