Rights concerning CEX

Hi,
My daughter bought an iphone 5 from CEX for £145 yesterday. She fully charged it before using it, however, she used it for an hour and the battery drained to 50%. I told her to take it back as obviously, the phone would only last a couple of hours before dying. She took it back today and was refused her money back and was offered store credit instead, can this be right? They are saying they did a 20 minute test on it, playing a video, which only used 4% of the battery, which can't be true. She has just told me the thing died at 30% and won't come back on! She has been put off of second hand phones and wants the money back to buy a new, cheaper phone.
Anyway, does she have the right to the money back?

The Consumer Rights Act gives her the right to reject goods which are not satisfactory quality, unfit for purpose or not as described within 30 days.
If the phone was not fit for purpose and she has rejected it, she has the right to insist on her money back.

How old is she? I have found these companies will try it on with a younger person but won't attempt it with someone older. Cex are also renowned for not always having enough cash in the till.0

Unfortunately that is a phone that first launched 4 years ago, so has 4 year old technology, and is probably second hand being from CEX so has been used for a while before your daughter got it.
It simply won't be able to handle modern apps which are battery and data hogs. Draining 50% in an hour is normal for a 4 year old phone, sorry.
My boyfriend had a 5s until very recently (so 3 years old) and his was getting just as bad as that, he just got a battery charger to carry about.0 -

Indeed, I've got a game on my samsung (2nd hand from the states) which can drain the whole battery within 1 hour!
Also, having 4G enabled somehow manages to drain it within 2-3 hours (no activity) and i often put it in flight mode.
But the phone does what it needs to do; namely call and text!
So yes, 50% after 1h is not impossible for an old phone with the right apps/4G connection going on!

I have a 5S and can get 6 hours battery out of it- in fact when we drove down to Cornwall recently on holiday I got 10 hours out of it! so it must be your BF is unlucky. There is a known battery fault with the 5 (I had one until I got my 5S two years ago) and there was a replacement programme that Apple rolled out at the time. My 5 handled 'modern' apps just fine- I had the battery replaced by Apple before I sold it on and in the few days I used it it was fine. Sorry if this has already been said, but their online (presumably similar to in-store) policy is on their website: CEX - Returns
Where they state that "Items that arrive faulty can be returned within the first 30 days for a full refund to the original payment method or a replacement" and "Should your order develop a fault within 30 days of receiving it, contact us as soon as possible for a full refund to the original payment method or a replacement."
Some CEX stores are franchises rather than owned by the company, but I would expect their franchises follow the same terms (otherwise they'd have to clearly state any differences surely?)

I think we're all missing the obvious - batteries lose capacity over time as they start to fail.
Apps using more CPU/RAM will affect life, but not by enough to halve it. When you consider the average Li Ion battery pack only lasts for 500-1000 charges, this is easily reached on a potentially 4 year old phone.
Genuine Apple replacement battery packs are about £10 on eBay, and changing them on the 5 is a 10 minute job for someone who works with tech.
Time to get in touch with that nerdy family member, and save a lot of hassle :beer:0
