Just wanted to post here about my PCN that has just been cancelled by smart parking,I want to thank everyone for the advice and help and for the template that was on this site,once again thank you

ok , now go back to the hire co and ask for a refund on the admin fee , if they will not then go after smart parking , why should you be out of pocket?Save a Rachael

no , because they were doing their job and charging a admin fee that you accepted when you signed the lease

smart did not know you were resident in Scotland , and as such applied a ticket , had this have gone to adjudication , and you had won you could have gone after smart for your loses , as it is , they have just backed downSave a Rachael

No, just ask your hire company (in writing, no darn phone calls!) and show them the charge was cancelled on first appeal so clearly was not properly given. Since the hire firm was never liable anyway, because Smart don't use the POFA 2012 and very obviously bypass 'keeper liability' and have no such right, you expect the hire company to refund the admin fee. Tell them that failure to refund the unnecessary charge (because they mistook this for a real PCN) will mean you will take the matter to the BVRLA adjudication* service to resolve this dispute.
*the hire firm won't like that and I fully expect every dispute referred costs them a heck of a lot more than they'd be refunding you.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
