POPLA appeal reject help

Please help.


POPLA (5962716783 POPLA PTL:0088387) appeal went in favor of Parking Ticketings Ltd (PTL).


Don’t know why as I thought I had a very good case.


I sent a document that showed that where I was parked, there were two signs. One saying private parking & one saying 1 hour parking. The private & shop parking bays are all on the same road and footpath, there are no lines or markings on the parking bays to say what signs they belong to. The private sign was not above my parking bay, but to the left of it. One hour sign could been seen from my driver’s window. No markings to say where private parking stops & shop parking starts. My document I sent shows all this. The document & pictures Parking Ticketings Ltd (PTL) sent make it look like all parking is private. I can email my document if needed. Just need to know if I should pay up or go to court if they take me to court? Thanks for any help with this.

    Even if you've lost at POPLA it places no obligation on you to pay it. Only a judge can do that.

    You will likely get a barrage of debt collector letters, which have no authority and can be safely ignored. Please read newbies FAQ sticky, post #4 which gives you information about dealing with debt collectors.

    PTL try the occasional court claim, which can be easily defended if you put in the time to deal with it, and people here will help you with it.

    It is by no means inevitable that a court claim will follow.

    Have you tried to ask the landowner/retailer to intervene - even at this late stage?

    Whatever did you put in your POPLA appeal to cause a loss to PTL? Can you let us see what you said - if it comes to court, seeing what you put in that appeal will possibly help us guide you down a better road.

    I was going to ask if this was a POPLA appeal that had been reviewed by the forum, but it doesn't really matter now I suppose.

    The answer is that it is recommended you *NEVER EVER PAY* **UNLESS** you have been taken to court and ordered to pay by a judge. Some companies are more litigious than others, so it may be that you will only get a seemingly never-ending stream of dodgy debt collector letters which you can ignore, or it might be that you end up having to talk to a judge.

    If you get a genuine LBCCC which comes from the Northampton Court, then come back to this forum and you'll get help. Otherwise you just have to ignore for 6 years.

    Now - some people are more comfortable with getting stroppy and feisty over this sort of thing than others, so if you aren't one of those people and you decide the stress isn't worth it, you may decide to pay and be done with it.

    If you do, that's up to you.

    But again:
    THE FORUM RECOMMENDED ADVICE IS TO NOW IGNORE EVERYTHING BUT A GENUINE LETTER FROM THE NORTHAMPTON COUNTY COURT BUSINESS CENTRE, IF YOUR APPEALS TO THE OPERATOR AND EITHER POPLA / IAS HAVE BEEN REJECTED!

    DO NOT BLANKET IGNORE WINDSCREEN OR POSTAL NOTICES!

    Not a sufficiently strong POPLA appeal from a quick glance. Lots of great photos and explanation, but too light on the stuff that really works at POPLA.

    Still, water under the bridge now. So you just wait to see what PTL's next move is. If it's debt collectors, just ignore, no need to come back. If you get court papers, don't ignore those, come back for further advice.

    Would pay you to have a read over this forum from time to time to keep abreast of the very rapid change that occurs. What's 'current' today in private parking is very likely to be quite different in 3 months time.

    Agreed, sit tight and don't worry. PTL are small fry and if they use Gladstones and send a LBCCC or a claim it is defendable - just some research work by you needed (with our help). No costs and no risk of a CCJ as long as you don't miss any court direction/deadline.

    We've never seen a Gladstones case defended on here this year go any further really, certainly none we've assisted have been lost and no-one has even reported the claim went as far as a hearing. People have confirmed that the case seemed to die away after DQ stage (a paperwork stage you will learn about only if you need help with a defence later).

    Keep all paperwork for SIX YEARS. And tell PTL in writing if you move house in that time, to ensure you miss no letters at all.
