Guys, can you please offer me your opinion on below:

The truth of this is the area is pitch black with zero lighting and the signage was impossible to see, it's in a pub car park and apparently you are required to enter your Reg into a machine in the bar, again I never saw this!

I am challenging this Parking Charge Notice

The signage was inadequate and and with no lighting available making the signage impossible to see. This is clearly demonstrated by your own photos, I also enclose photos taken around the same time which clearly demonstrates the total lack of lighting making any signage impossible to see.

Parking Eye provided no consideration and no contract could possibly be formed with the driver.

The amount you have demanded cannot possibly be a genuine pre-estimate of any loss to either organisation.


I require that the parking notice is cancelled or you provide the validation code to refer the matter to POPLA

    I challenge this 'PCN' as keeper of the car and I will complain to the landowner about the matter if it is not cancelled.

    I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs were not seen by the driver, are in very small print and the terms are not readable to drivers.

    Further, I understand you do not own the car park and you have given me no information about your policy with the landowner or on site businesses, to cancel such a charge. So please supply that policy as required under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You have omitted clear information about the process for complaints including a geographical address of the landowner.

    There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.

    I have kept proof of submission of this appeal and look forward to your reply.

    yes, that one (it is blue and is in the NEWBIES sticky thread too)

    ANPR photos are dark anyway as they only have to show the VRM, they are not passport style photos

    but any such complaints about lighting and clarity and lack of bar signs etc should be made, by the keeper , later at POPLA (or in court) , including your photos

    never reveal who was driving so edit post #1 accordingly

    Their not interested, a search on tripadviser shows the staff are getting a lot of abuse but just not interested
