Euro Car Parks - No response to first appeal

Hi all,

I first received contact from ECP on the 20th July with a NTK, no chance given to pay at discounted amount (not saying I would being paying these crooks!)

Details seem very limited and I'm sure this is uncomplainant in a number of ways. It just states 'Your vehicle was parked longer than the maximum period allowed.' They included a time, I'm guessing that's when they may have issued the 'invoice' but no time-stamps to say when the entered and exited the car park.

Also the address is rather vague. It just states Sainsburys followed by town name. There are two stores within 10-15 minutes of each other so I have no idea which one they are trying to refer to.

Anyways I appealed using template letter on the 29th July and have had no reply since. I checked emails regularly and saw no response from them.

I appealed using their web-form. I also saved screenshots of this and had an email to state they had received my appeal.

My question is how to proceed with this? Should I not respond until I next hear from them or should I consider emailing either ECP or the BPA to complain?

    Check your junk mail folder maybe?

    I wouldn't respond to them - no point tipping them off! - but feel free to get in touch with BPA.

    Point out to them the breach of the BPA COP (which states that there should always be a discount offered for prompt payment). Point out to them the failure of the NtK to comply with POFA 2012 Schedule 4.

    What was the date of the alleged infraction anyway? Was it the case that the car was parked for that long, or could you be a double-dipping victim?

    Hi thanks for the reply.

    Date of Issue was 18/06 and NTK was received on 20/07. Could well have overstayed on this occasion but to be honest can't recall if I did or not. The NTK states that "vehicle was parked longer than the maximum period allowed" and doesn't actually say how long it went over etc. No pictures or time-stamps provided on NTK.

    I have been keeping an eye on junk mail I probs would have seen it tbh as they have their very own email address especially made so I did not miss it!

    Was actually expecting a postal response but I guess if you appeal online they will respond via email.

    So best to bring this to BPA attention and cc. ECP in?

    Point this out to them - you only need to tell them this and no more - and then invite them to f*** right off.

    Meaning "We've hashed this up, but whatever you do, don't admit how much of a balls of a painfully simple process we've made, as that might affect our legitimacy!"

    Not a gesture of goodwill. Closed because they've screwed it all up so badly they've no recourse to to either try it on through debt collectors and hope you get scared (which would fail), or to try it on through the courts (where they would summarily be told to FRO).

    None of which matters to you - as your aim of getting it binned off has been achieved. Congratulations.

    **EDIT**

    Email them back immediately and insist on written confirmation that, as the ticket has been cancelled, any and all personal information they hold on you has been deleted from their systems in accordance with the requirements of the DPA, including (but not limited to) images of your vehicle, records of the reg number and any information they have been given by the DVLA as part of their application for Keeper Details under the KADOE contract.
