Uninsured car, accident not at fault..

Options
I missed my car insurance renewal by one day.
Unfortunately, my wife had a minor accident.
Someone hit her from behind, causing the bumper to crack.
No police involved, no injury, he claimed the fault, details has been exchanged.

When she got home we got a message from his insurance company that they already know about the accident and they confirm that their client is at fault and they want to take care of the cost.

My wife called them to say that she is happy for them to take care but they said that we need to notify our car insurance too.

What our options are?
If we say that we did not have insurance on that day, will they notify police?
Can we just call them to say that we do not want to claim?
(the crack is very small and although in normal circumstances I would claim the cost, now I'm not sure if we should have)

  • If the renewal was going through at the time, no problem.

If the renewal was forgotten about, you maybe on your own.

perhaps put the car insurance renewal dates in your phone, diary e.t.c in future.

Whether or not you were insured is irrelevant to the claim.

And you breach your policy conditions by not informing your insurer.

(Now that the third party has reported to his insurer this incident will be put on the shared database, so you need to disclose it)
  • Thank you for the reply.
I had no insurance at that day.
    My old insurance ended 25.10
My new one started on 27.10.
For this one day we did not have any insurance.

To whom to report that then?

Was your insurance that you started on 27/10 informed of the accident?

You were hit by someone, it was their fault, they must pay for the damage.

The fact you were uninsured is not relevant. The problem would be if they turn round and say it is your fault or refuse to pay up, you are then on your own with no one to fight your corner. You have had an incident (and the insurance system is aware), you have to tell your new insurers whether you claim or not. Your premium is likely to increase because of this.

Having the accident before you started your new policy could cause you problems, best come clean now before they find out and cancel your policy due to your fraudulent misrepresentation (yes, that is what you have done), the consequences of that will be far worse than the driving uninsured. No need to tell them you were uninsured at the time (unless they ask).

I mean that you not being insured makes no difference to your claim against the liable third party!

You should have reported the incident when taking out your insurance the day after the incident.

You have no option but to report it now ( as it's already been reported by the third party)

Failure to do so will allow your insurer to void your policy, which could be expensive should they find out on checking you out following a claim!

I'm sure you've checked this, but...

Most insurance companies auto-renew policies each year. Did you tell your insurers not to auto-renew?

(TBH, this scenario is exactly why I like auto-renew. If I have a 'mental aberration' one year and forget to react to a renewal notice, I'm still covered.)
  • This is a case in point for auto renewal of insurance. This way you remain covered, whatever happens. My insurer writes to me, telling me each year what the cost is to be, and if I agree, I do nothing more. If I change, all it takes is a phone call.

And when I have been involved in a minor skirmish, my insurer deals with it. That us what I pay for.
