I really don't know what to do.
If after doing that research you still can't handle it, start a new thread of your own to see if anyone can help direct you. One thread, one case is required otherwise it can lead to confusion and cross-advising.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Once you have done a bit more reading you will know that that £154 is £54 too much.
They are attempting to obtain from you monies to which their client is not entitled. That is fraud in my book, and definitely not the way a solicitor should be behave.
They are being investigated for this and other irregularities and you should complain to Duncan Allen, SRA,

The more complains they get, the more likely it is that this firm will be struck off.You never know how far you can go until you go too far.0 -
Hi Pam,
Welcome to the fray. It looks like we're in a similar position in terms of progress through this frustrating farce.
I've done a fair bit of research regarding the whole affair, and frustratingly BW Legal seem to be targeting the keepers of vehicles as oppose to the driver of the vehicle at any particular point in time.
I drafted up a letter (using the brilliant advice from these lovely folks in the forum and the copy/paste function) which you can see in the post from 30/10/2016 at 10:29. Feel free to adopt it to suit your needs. I would highly recommend reading everything you can on this subject. It is time intensive and not particularly exciting, but having the knowledge of how these solicitors work can only be a good thing.
Good luck and happy hunting. These Violent Delights Have Violent Ends.0 -

I parked in an excel parking services car park in December 2015, the parking was only 60p for an hour, but the pay machine was out of order and had a sleeve on it, there was no other parking meter. So I nipped into a shop, I was only there for 10 minutes and left.
A few months later, I received a fine from parking excel. I appealed and said that the machine was out of order and I couldn't use to pay (it was only 60p - I would have paid it if I could). I have no evidence that the machine was out of order, because I didn't get the fine until a few months later and I thought nothing of it at the time.
The said my appeal was not valid and I had to pay the fine.
After looking on forums like this, I decided to ignore the rest of the letters.
I am now getting letters from BW Legal saying I must pay £154 or I will be taken to court and have a CCJ. I am slightly worried now, because my credit history is fantastic.
Do I continue to ignore these letters or pay? I really don't know what to do.

You may like to start your own thread as well for tailored advice - your credit history won't be wrecked unless you ignore court papers/ and receive a default judgment or lose in court AND fail to pay any such judgment within the time allowed.
At BW Legal stage you are not quite at court stage - and they have a series of letters they typically send out .0 -

Yes and they will try the Elliot v Loake arugment at some point - however you may find this blog interesting

Some friendly advice on this forum
Do not accept PM's from anyone with less than 1000 posts on here

Some friendly advice ..... be wary if someone responds to you by PM if they have less than 1000 posts. It may not be what you think0 -
Letter printed and due to be posted later on.
I managed to photograph the whole area yesterday. The signs that are now up seem pretty legitimate and frankly, they're EVERYWHERE! Im not certain, but there seems to be a lot more signage now than there was over the summer. (Or im just noticing it more now.) Either way, I'd like to add the photographs to this thread, so i can 'muse out loud' so to speak.
Another avenue im going to try pursuing is contacting the land owner and requesting the fine be struck off. Its land either owned by the Sheffield Teaching Hospitals or by Sheffield Health and Social Care. These Violent Delights Have Violent Ends.0 -
Hi all,
A quick update, thank you and question:
I've not heard a thing from BW legal, presumably they're formulating some fear mongery response. Looking forward to reading it. Fully expecting tales of Elliot v Loake.
I feel fairly confident that the signage was changed between the vehicle being invoiced by VCS and a letter being sent to my address. Am i right in thinking that i can request a detailed description of when and how the site was modified?
Once again a huge thank you to everyone, and ill be sure to attach (links) images of the next letter. It might give someone a laugh!
