BW Legal - I think I lost

Good evening all,

I suppose this is part obituary and part plea for a last opinion. I have spent the last two days researching BW Legal and VCS, and honestly, there is so much information it is overwhelming. From what i've seen...... i think i'm screwed.

My vehicle was parked in a private care park that is largely unused, barrier-less and well sign posted. A VCS invoice was placed on the windscreen on 22 July 2016 as is usual. With great advice from colleagues, the invoice was thrown away and I choose to ignore the following - posted letter from VCS on 16th September 2016 requesting payment of the full sum of £100. Though 56 days after the contravention, i did not appeal. Once again, the letter was discarded.

And now, dated 24th October 2016, a letter from BW Legal. £154.00 for the privilege of parking at my place of work!

So far as i can tell, i've played the game back to front and upside down with little choice but to pay BW legal. Any advice or any condolences would be greatly appreciated.

As you can tell, i've largely given up, now wallowing in my own stupidity. One last thing, any reason to use the Help with BW Legal on "bankruptcyadvice-online.co.uk"? Do we think they exist to help or hinder?

    You've got the usual daft template £154 letter from BW Legal and you think you've LOST?! Everyone gets that letter. Everyone replies to that letter.

    No-one here has lost a BW Legal case but we've seen how useless they are so far in the cases that have made it to a hearing:

    Get a grip and read other BW Legal threads to find out the merry dance you can now play to beat this in the end. If you have never responded then they DO NOT KNOW WHO WAS DRIVING. And VCS do not use the POFA so cannot hold a registered keeper liable nor can they presume the driver was the keeper (but BW Legal will tell you all about Elliott v Loake and pretend that they can).

    Edit your first post to remove info about who parked. Do that now and calm down, wallet back in pocket.

    The advice to ignore private parking tickets has not been given here since the law changed in 2012. Send your colleagues here to the NEWBIES thread for re-educating.

    Why are you looking at bankruptcyadvice-online.co.uk ???
    Who pointed you to that site ? was it BWLegal ?

    This is not a bankruptcy issue

    You must understand that you have been caught in a honey/scam trap. This is not a real debt as we know it.

    BWLegal keep on sending out these scary letters and this has resulted in many complaints about them to the SRA so they are currently under investigation.

    This week, BWLegal were blasted by a court judge and frankly, it is very rare for judge to say what she did and her actions.

    The judge was clearly very disturbed that BWLegal brought this scam to court and it will probably mean that a "marker" is placed within the county court system to warn other judges about BWLegal

    It is possible that BWLegal are now going to be spanked many times in courts.
    BWLegal will never know until they are in front of a judge if another spanking is due to them

    If they send you a real court claim just come back here.
    Remember ..... the claim they are making is extortionate so keep your nerve as BWlegal have proven that they are not the smartest page in the book

    That extra £54 is unlawful. They know it, and we know that they are being investigated for this and similar offences, hopefully they will soon be struck off.

    The appear to be attempting to obtain monies for their clients for which they have no entitlement, that is fraud in my book, not the sort of thing a reputable solicitor should be about.

    It makes you wonder if the SRA are getting a cut from BW Legal, surley they should have been delt with by now.:eek:
    PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue. :eek:

    Bit strange that they were requesting full payment of £100 from the keeper. Under the IPC's Codes of Practice, Parts C. 3.1 (m) it states that they should inform the keeper of any discount for prompt payment. According to your post, they didn't.

    Again, we have a 'newbie' with just 1 post who has joined MSE solely to inform members that they are seriously considering making payment. If that's the case, why not get on with it and not waste the forums time.

    Please come back and update your thread even if it's just to deny that you are a troll or even worse - a ppc mole !
  • Hi all, apologies for the blanket silence. Not a troll, just a dad with two kids under 4. At present im putting together two letters as per advice above. Ill go into much more detail on this later tonight if that's okay. (A letter to BW Legal with a bucket load of complaints and counter justifications AND a letter to SRA)

    The fighting talk is rather infectious in this forum and im happy to report that cliffs and sharp objects no longer pose a danger!

    Ill report back later hopefully with a response in kind to each poster. Again thank you all for the advice thus far.
