Section 75 dispute over Lowcostholidays

I'm new to the forums but wondered if anyone could give me some advice. I've made a claim under Section 75 to reclaim the money I paid to Lowcostholidays on my Santander credit card. I booked a flight and hotel together, costing £1,900. They've refunded me the cost of the hotel but not the flights.

The explanation I've been given is that the flights could still be used as it wasn't Ryanair that went into liquidation. I've tried explaining that I couldn't use the flights as I didn't have the hotel but that hasn't made a difference. Santander have advised me to go to Trading Sandards but I don't understand why they're not refunding me the whole cost of the holiday.

Any help would be much appreciated.

  • why not jusat book a different hotel and use flights

    Has the date for the flights already passed?
    If so, why did you not utilise the flights in conjunction with the same hotel and then claim the cost of rebooking from Santander?

    Yes, the date has passed now. We couldn't book the same hotel; when I called and emailed them they just kept saying they were fully booked. I tried other hotels but at such short notice there was no availability. I thought, because I booked the hotel and flights together, and relied on them both being available, that I'd be refunded for both, even though I know Ryanair did nothing wrong in terms of the flights still being available to use. I couldn't get on a flight with my family knowing we had nowhere to go once we landed!

    That's the problem with this sites that make you a "package" you are booking two separate things, If you look at your documentation the flights and accommodation will probably even have been separated into two different charge, Could be worth trying to claim on your travel insurance

    Yes, the flights and hotel appear as two different costs, rather than a total amount. Already tried the insurance and they said we weren't covered for the company going into administration. I've submitted a claim with the administrators but that's also unlikely to refund me. It's so frustrating when you make a payment for both elements in good faith, relying on both the flight and accommodation together, and then there's no recourse when one of the elements fails.
  • The was no other sensible accommodation anywhere within reasonable distance of the airport?

    I don't think you looked very hard.

    Waste of time, as even if administrator was going to refund you didn't lose money on the flights as you still had them available,

    LCG admistrators aren't going to refund you for something that was fully available for use. Had you had the correct insurance cover for travelling independently you would have be able to reclaim the cost of the flights.

    Just checked back on my previous posts/replies and I noticed I didn't ask for your view on how hard I tried to look for alternative accommodation.

    I thought this forum was supposed to help people who asked for advice?
