They would have to use the courts like anyone else.

Hi Sourcrates thanks so much for your help so far.
Stupidly I have not done any of the above, above from tell my family to ignore the calls (which they have answered unknowingly and just have said to call later...!!?! doh).
They have now sent me a letter saying that they need my attention and that there is a potential as I have not updated them in over 12 months re my situation for legal action and that they could use the courts etc.
they are asking that I call them...
They also state that my credit file indicates that my situation may have changed recently (HAVE THEY BEEN CREDIT CHECKING ME?!!?!?!?! or is this a ploy?????!?!?)

Hi,
Advice in post #6# still stands.
Don't speak to them on the phone, insist they contact you in writing only.
Unfortunately if they want to take you to court, you can't stop them, but you can't be made to pay more than what's affordable.
You were advised what to do, and You've had a month to respond to them, there not going to go away.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Thanks sourcrates, I will post this tomorrow signed for?
Is there a template for a letter like this?
What concerns me is that they have obviously been monitoring my financial situation because they state my credit file has changed (which is is good now! as I always pay my bills on time and overpay if I can).
Have they been checking me...?
My situation is better but not all that much!!!
Should I send them a harassment letter also?0 -
Dear Cabot,
Re Acc no : xxxx xxxx
I refer to your recent correspondence.
My situation remains as before, so I can only afford to pay £0.00 on a monthly basis. (I enclose a copy of my recent budget).
Should my situation change in the future, I will be in touch with you to discuss my options, until then, I must insist that all future contact be in writing only, as the amount, and frequency of your phone calls may, in my option, constitute harassment, and I am seriously considering registering a complaint to that end.

Thank you so much.
I will get this letter off at once!.
CAB used to deal with this for me but they've not replied since I emailed them quite sometime ago.
Is there a way I can check if they are monitoring me?
My credit file shows some rather large credit limits and whatnot but they are not affordable to get rid of Cabot using them that would only worsen my situation. the limits have got higher with the fact that my brother has borrowed money and paid it back every month at like a grand or two and thus building my Credit rating up for me. maybe this hasn't helped.0 -
Tell your brother to get his own credit card.0

sourcrates wrote: »Ok, if I were you I'd just send a simple letter stating your financial situation has not changed, and leave it at that.
That's unless you want to pay more to get rid of it quicker ?
I've sent the letter signed delivery today.
I do want to pay it quicker 've worked out that.
My situation is better than what it was in 2013, I've £100 to offer per month to all of my creditors. This would then be split debt accordingly.
Now that I've sent the harassment letter how do I approach this next bit as they want an update.....0 -

Work out what you can afford and tell them your payment will increase to (amount) and you will start paying this from (date).

Well the template that Sourcrates posted for you mentioned including a copy of your recent budget... Did you include that with your letter?
Ultimately they can't have what you haven't got... but if your defaults have dropped off your credit report that would increase your credit "score" (for lack of a better term right now) too, not just your brother managing a card in your name. Which I wouldn't really recommend in all honesty but that's up to you.
If you want to post up an SOA for sending to them before you post it then by all means we can have a look at that for you.DFW Nerd #025DFW no more! Officially debt free 2017 - now joining the MFW's!
