    I am dealing with gladstones at the moment too. Is there any templates around which would help me in compiling a letter to complain to to the SRA?

    Yes, pbabb2012's BW Legal thread on pepipoo and LoveNorfolk's BW Legal thread on here. Not Gladstones ones but it shows you how to word it (basically you need to go and read the SRA Code and find how they've contravened it.

  • I have received this letter from Gladstones and am a little confused as it arrived two days before MCOL sent out the N180 to me.

    It included their N180 with a request in D1 to be heard on paper and an empty N159 request for it to be heard on paper. No details on it at all.

    The signature box just has DS in capital letters. No signature.

    1.Is this usual to be sent their copy before it's sent out by the court?
    2.Do the courts usually send the N180 to the Claimant before it's sent to the Defendant?

    I have a feeling that this is another attempt to intimidate but it may be usual practice.

    What do I do with the 159? Only the N180 has arrived for me from the court?

    Hope this is enough information, but I have full copies of all I could post if needed

    just read similar Glads court claim threads and then refuse to allow the above and insist on a court hearing , this is standard for GLADS and people are told to refuse it, also see bargepoles latest posts on court claims so you get the gist (check the newbies sticky thread)

    I have followed bargepoles posts and other Gladstone threads indeed am refusing that on my N180 in the D1.
    My questions arose as I was surprised to get Gladstone,s N180 BEFORE they were set out by the court!
    Whether it is likely theirs would have been sent before mine by at least three days.
    Also whether a typed signature DS counts?

    I know it is standard practice for Gladstones to request this and was prepared, thanks to bargepole.
    An N180 is an N180 whenever it was prepared I imagine.
    Just wondering about the, to me, strange timing.

    its clear from other threads on here and on pepipoo, prankster blogs and accounts by people "in the know" that GLADS dont get paid enough to do the job properly, so why worry ? who cares ?

    they send out small claims limited to 5k for £15 million , £17 millon etc , its clear that its not done properly, so all grist to the milll

    I suggest you concentrate on what you should do and not why Gladstones fail or why they do what they do (or dont)

    to me it sidetracks you from the issues that you should concentrate on, which I am sure is all part of their smoke and mirrors strategy

    A S Parking appear to have seen the light, maybe others will too ?

    deal with what you see by following advice from bargepole , coupon mad and other good people , dont worry about GLADS

    You of course are right! What difference does it make to me what Gladstones do.
    I'll not waste any more thought or energy on them (other than court directions of course)
    I had indeed missed the recent posts which mirror mine and the advice therein so thanks for the link.

    Could you please look through it to see if it's acceptable?

    Also I prefer to email it to Northampton but I understand it's not wise to email their copy to Gladstone's. Is this correct?

    The Defendant opposes the Claimant’s request for special directions and requests that the case be listed for an oral hearing at the Defendant’s local court.

    It is noted that this serial litigator has failed to provide any coherent particulars of claim, providing no details except a date and a sum of money unrelated to any parking tariff. There are many similar claims issued by Gladstones, in the public domain, for parking companies which also follow the same ‘cut and paste’ model that omit any facts at all. The template particulars are vague and seem to be incapable of giving rise to any lawful contractual claim.
    The omissions prejudice the defendants right, as registered vehicle keeper, to understand the issues, make informed decisions and compile responses in defence.
    The conduct of the Claimant and their Solicitor suggests a complete disregard for the CPR overriding objective when dealing with unrepresented Defendants (as in this case)

    The conduct of the Claimant and their Solicitor in pursuing scattergun, copied and undetailed claims which appear to be a cheap form of debt collection with the intention of intimidating consumers unused to the court process leads the Defendant to request that the case be referred for any pre-hearing directions specific to this case as the judge may see fit.
