WH have not addressed any of the points you raised. I would turn up the heat as imo they would come a cropper in court. You never know how far you can go until you go too far.0

Thanks The Deep, I have drafted the below, can someone please advise if this is good enough..? having read a lot of other posts I've noticed users have been quoting x -V- y court cases, is there any relevance to add any such court case to my response? I've also read a little about compliance of Practice Direction on Pre-action Conduct and wondering if thier original LBC is in compliance and if not should I add that?
my letter so far..
Dear Tim,
Wright Hassel Ref: xxxxx
Thank you for your letter xx/01/2017
I note that you have not addressed points 1 or 3 from my letter and have only brushed over the second point and not specifically provided evidence of your client having complied with 9(2)(e) from the Schedule 4 of the POFA 2012.
I suggest you re-read all letters sent to me by the Creditor Globe Protection and your client the debt collector ZZPS.
I would also like to remind you of the guidance given to operators in POPLA's 2015 Annual Report by Henry Greenslade, Chief Adjudicator in which he reminded them of a keeper's right not to name the driver whilst still not being held liable for an unpaid parking charge under Schedule 4 of POFA
On this basis your client has no legal reason to pursue me and further attempts to scare me into paying the alleged unlawful invoice will be considered harassment.
For the avoidance of doubt, I do not give you consent to process data relating to me or this vehicle, whether you have already obtained it or not. I deny liability for any sum at all and you must consider this letter a Section 10 Notice under the DPA. You are required to respond within 21 days0 -
Hi, can someone please review my above post and advise?
Many thanks0 -
Bump - can someone i.e. coupon mad please review my above post and help on next actions
Please0 -
sorry to keep bumping this, still waiting on any advice on my reply to WH.
Is anyone able ot help please! i want to be showing to respond in case they do send court papers...0 -
Hi All
So I ended up sending the letter as per my post 43 and received another reply from WH, (http://postimg.org/image/3ntsx1u3l). Back in Nov some of the experts advised to ignore them and instead send the updated IPC template to the PPC directly which I did; and never received a reply. (see my previosu posts from 9 onwards)
I am now at a loss as to how to progress, do I reply stating I did appeal to the PPC directly or is there somehting else I need to write back with? This is all very frustrating and stressful!
Someone please advise0 -
Hello,
Can someone please advise next course of action, Coupon Mad, Redx, Umkomaas???....anyone please!0 -
I'm also very keen to hear any thoughts and further actions on this thread, being in pretty much the same position as homer77 (I sent you a private message about the whole thing by the way dude), just not quite so into it, having only just replied to the letter of claim I received from Wright Hassall!0

You don't need to reply to LBCs from WH, acting as ZZPS = debt collector mode only:
https://bmpa.zendesk.com/hc/en-us/articles/203747112-Wright-Hassall
Always look firms up on the BMPA website resource, it is great for information, tips and advice.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
