Yes - a month. I'm finding your posts very useful in that you appear to be arguing the scaffolders point of view. Are you a scaffolder? Or do you think I'm being unreasonable? Your suggestion of how we get them to remove it (the letter) is roughly the approach I'm taking.
In NZ, there is a legally over-riding principle of 'reasonableness', and you can't contract out of that. Does the same thing apply here, does anyone know?
Mope. I was just being the voice of reason. I have a good knowledge of the law and a reasonable knowledge of tradespeople!
They had done nothing illegal and contract disputes need arguing in a court if both sides don't agree. I gave you some legal suggestions to make them buck their ideas up and as long as they are worded well and carried out properly would be legal and would leave you in a strong position. As it happens the kick up the bum was all they needed.
Contracts in this country have to have an offer, consideration and an acceptance. They also need to be mutually beneficial. Some terms can be considered unfair but again these would need to be argued in Court.
I'm glad everything was sorted for you. I would seek advice much sooner next time as it will save you much headache.0
