Best thing to do is don't help if you're too busy.

I was only after an answer to a question that has not been answered!

The regulars have helped by telling you to ignore this because you are in Scotland. There is no hypothetical situation unless you are stupid enough to make contact with the scammers and reveal the driver's details.
You can't give that information away if you ignore them.

There is no need for you to ask any other questions. The POFA 2012 does not exist in Scotland so the keeper cannot be held liable therefore the keeper cannot be taken to court.

Why do people think there is an answer to any and every question they ask? (That's rhetorical - but feel free to answer! :rotfl:).
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Prior to the Protection of Freedoms Act 2012, only the driver was liable to the private parking companies and is why the advice then was to ignore any letters from those companies and their associates and not to identify the driver.

The Protection of Freedoms Act gave the power, as long as they comply with the conditions of the act, to claim from the keeper.

The Protection of Freedoms Act only applies in England and Wales, so any claims in Scotland can still only be against the driver, which is why the private parking companies try, with irrelevant mention of Beavis etc, to worry the keeper (with scary, almost threatening letters) and get them to identify the driver.

They cannot claim against the keeper in Scotland (despite their threats to do so) and as long as the driver is not identified, they have no-one to claim from.

Which is why the advice is to ignore.
