I have just been into court here in swindon. When other banks sent a representative to court Abbey did not. Abbey have removed our over draft and placed us on a bad debit list can the bank do this? If these charges have been knowing removed from our account in the full knowledge that the money removed was more than entitled to, and the banks have been telling people that they can remove these funds, have the banks not committed an act of theft and fraud against their customers?

I read the post! I had a long conversation today with Kate Farrow at OFT. We discussed the possibility of the OFT/FSA making a statement of clarification about the test case not applying to credit cards and hardship
cases in order that it can be used to back up claims. They were already working on it because Martin suggested it.0 -

I have addressed court. As my thread says, i need proof for court. The judge as rejected my arguement that credit cards are not included.
Only the people who caused the current mess can clear this up with the courts, ie the FOS, FSA and OFT.
And it sounds like Martin has got an agreement that this will now happen.0 -

Q: Does this test case and the suspension of unauthorised overdraft claims apply to my credit card complaint?
A: No this test case and the suspension applies only to complaints about unauthorised overdraft charges and the law which applies to them.
