Can someone help me? UNFAIR PARKING TICKET WITH NO VEHICLE PRESENT.

Hi All,

I'm fuming, I've just came home from work and my mum is having building refurbishment carried out by builders at her other address local to where we live.

A local builders merchant had delivered our block slabs directly outside the home on the road for us to unload the slabs and take them inside. We have no driveway access and no drop curb directly outside our home. Hence why the delivery driver had placed them next to the raised foot path on the road for us to unload.

A ticket warden decided to slap a parking ticket on the slabs???

There is no single yellow, no double yellow, no red markings, no pay and display bays...nothing.

Is this fair? slabs was only placed there for unloading and to unpack the goods to be moved immediately.

im guessing this warden has had a good day in commission!

Is there a legislation, or a something that can defend our case if we appeal?

    Nope, nor can slabs be in contravention of a traffic order. What VRN is on the penalty charge, the reg of the lorry? If so then THIS IS NOT YOURS TO CONTEST. IT IS FOR THE SLAB DELIVERY FIRM (LORRY OWNERS) TO CONTEST - AND THEY CAN.

    Just a thought - are you SURE the CEO put the PCN there or did he/she serve it into the hands of the builder who got annoyed and plonked it on the slabs? A CEO can serve a PCN onto a windscreen or into the hands of the driver.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • What contravention code did they use? It would be interesting to know what kind of offence (which is within their remit) they thought the paving slabs were committing. Since there's no VRN, there can be no tying it to any individual.

    There's probably some Road Traffic law which prevents you dumping random objects which are not vehicles on the highway, but that's probably something for the police to enforce.

    This has got to have been issued to the lorry that delivered the load, I wonder if the wardens Hand Held Terminal would even issue a ticket with no VRN entered.

  • My guess its a warden with a sense of humour (I'm sure they do). One to boast about in the staff canteen.
