Even if they did have proof, if you left the site to visit a cash machine to obtain cash to spend on site they would struggle, (section 62 Consumer rights Act).
You never know how far you can go until you go too far.

Amazing! I wonder if UKPC are trying to be seen to play nicely right now.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I thought of this but then I assumed they may ask to see evidence as it would have been on my bank statement.
  • Even with the recent spate of successes appealing to UKPC on "leaving site" charges, I think it is important to use Coupon Mad's template initial appeal, even if only to demonstrate that you are not some mug who is just going to roll over and pay.

Maybe they have been getting a good 'rollocking' from their Principal for targeting genuine customers. After all, they are being paid to deliver a service for owner and customer alike !
  • Hey guys,

In exactly the same boat as the OP, car was "charged" yesterday for leaving the site. So rather than wait the 26 days before starting an appeal what's to stop the keeper doing it now? Receipt evidence can be provided if required.

I just want the whole thing out the way if I'm honest...

You need to read and understand the NEWBIES sticky so you know why the 26 day point is recommended, otherwise you risk blowing one of your most important appeal points out of the water.

The only guaranteed way to achieve this is to pay them. They have the balance of 6 years to pursue you to court, but you can avoid that via the two appeals processes you will need to go through to kill this off.

Have you complained to the retailer/landowner yet?

Please, any further replies should be on your own new thread, otherwise things get very confusing. Forum rules require one case, one thread.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thanks for the reply, duly noted.

No, not complained yet. My receipt is with Staples (one of the stores adjacent to the carpark) should I complain straight to them? Is there a template :D

    Also, is complaining online/email sufficient?

    Thanks.
