Missed deadline to appeal Indigo PCN (Byelaw14)

Hi, I would really appreciate your help with this ticket I received for parking without paying at my local train station on 2nd August. I ran for the train and forgot to pay. I came back to a Penalty Notice from Indigo saying:

This car park is regulated by the terms and conditions of parking displayed at the car park in accordance with Rail Byelaw 14. By entering the car park you have agreed and are contracted to be legally bound by those terms and conditions.

To be totally honest I had a quick scan here and decided to wait to week 3 to appeal, they do mention POPLA as an option if they reject my appeal. But stupidly I totally forgot and today I received a scary looking letter from PPN Debt Recovery and Prosecution Service demanding the £100 fine.

Is it too late now to fight this ticket and should I just pay up the £100?

    No you are not too late, that is the first letter so send the appeal now. The letter should say how the keeper can appeal.

  • So are you saying they put a "ticket" on the car windscreen and then when that was ignored they went straight to sending a debt collection letter without first of all sending you a Notice to Keeper?

    Yes, I think that Indigo do not send their own NTK and this letter is 'it'! Hence it is time to appeal.

  • Hi, sorry for the delay. We had an emergency at at home which completely took over.
    Yes, the letter says that this letter is the Notice to Owner.

    On what what basis should I appeal? Also, shall I appeal to the address on the original ticket, because this Notice to Owner does not mention anything about the option to appeal.

    Wonder if they have changed now the byelaw scam has been rumbled.

    Could you take the personal details off including times/dates and post it up to see how the wording might have changed.

    Host it on (free to use) Photobucket or Tinypic and copy a broken link (copy the URL and change the http to hxxp) and we'll convert it so it can be viewed via this thread.
