Hi all,

Asking from a technicality point of view, I recently moved homes and didnt think to re-registered my car at my new address so the NTK was sent to my old address (my parents). As a technicality, can I do anything about the fact that I didnt receive the letter within allotted time or should I just pay because I went an hour over the 2 1/2 limit?

    Amend your post to remove anything about who did what.

    Then, read the sticky thread for NEWBIES before sending the BPA template in blue to parking lie. Copy and paste, do not edit. Never ever admit who was driving.

    You will then need to read up on how to beat the parking scammers with a second stage appeal to PoPLA. You may have an appeal point based on the NTK didn't arrive in time to make the keeper liable under the POFA 2012, so please tell us the date of the alleged event, and the date the NTK was delivered to the address held by the DVLA.

    You must also tell the DVLA of your new address for both your driving licence and vehicle details. Two letters because the DVLA departments don't talk to each other. It's a thousand quid penalty if you get caught, so do this first.
    You should then tell parking lie of your new address when you appeal.
    Keep screenshots when you send it in as proof.
    I would not be surprised if they keep sending stuff to your old address, deliberately in the hope that you don't get it. Complain to the BPA if that happens.

    Finally, don't park in a car park where parking lie operate. It wouldn't mattered if you had been a genuine ASDA customer but overstayed, you would still have been targeted.

    The PE/Asda cases are starting to roll in. The new Asda CEO needs to be appraised by victims about why they will never step inside one of his stores ever again, or at least while PE are lying in wait to penalise them.

    @OP, while I understand what you're saying about this incident, you can still complain to the CEO (Google his name - he's brand new to the job) and tell him you're 'done' with Asda. If you're a regular customer and you have old receipts or cc/bank statements showing patronage, send him copies (statements redacted of critical detail like account numbers etc).

    If you pay you've been mugged - don't even think about it!

    This is not about excuses or what you 'did wrong' and just because you've seen the letter too late to 'appeal' and will get the usual debt collector letters we all laugh at (discussed all over the forum) is NOT a reason to think your only option is to pay:

    Did the PCN have a paragraph about keeper liability after 29 days under the POFA 2012? Or a blank space at the bottom? Have a look and tell us please.

    An option I would do, is ask your PARENTS to reply on ParkingEye's 'contact us' page today, calling themselves 'none of the above' and saying they are worried about the PCN that has arrived but can advise that in fact the registered keeper has moved to (new address) so please can they re-send the PCN immediately as they are sure you will want to know about it and appeal.

    Tell them not to comment about WHEN you moved, any fault, any excuse nor who might have been driving!

    I've done that before for someone and it worked like a treat, the person then got a fresh ParkingEye PCN with 28 days to appeal and was able to appeal AS KEEPER (as per the NEWBIES Thread advice).

    I did read the articles and attempted to contact the store first as advised but they said I had to deal with PE directly. I was then under the impression my situation did not really fit into the templates but perhaps I need to understand how to use the templates.

    I will go and update my car registration, didnt think about that when I moved! thanks!

    There is a notice that 'you are warned that if, after 29 days from the date given (which is presumed to be the second working day after the date issued) the parking charge has not been paid in full and we do not know both the name and current postal address of the driver, we have the right to recover any unpaid part of the parking charge from you.

    So I havent paid anything yet, the letter is at my parents house but I am aware its been sent so just wondering if there is anything to utilise this to help my case as technically I have not received the letter.

    NO.

    As advised above, this will work - get your parents to give your new address (NOT BY PHONE). You will get a fresh PCN delivered and can start again.

    An Update - I've emailed CEO of Asda and customer support on twitter. I have also asked my parents to inform PE of the registered keepers new address and will work both angles.

    Once I receive the new PCN I will see where I am re. Asda approach and will give the BPA template a go.

    In the meantime, should I worry about the jump in fine for not responding or wait until the new PCN is sent out?

    Will come back when I hear from any of them!

    One simple question needs to be asked of the CEO's of these supermarkets:-

    "Are you happy to see your (ex) customers taken to court by Parking Eye for simple breaches of their made-up rules" .
