ParkingEye scammers caught out by canny motorist using dashcam

Long-time scammers ParkingEye have been caught out trying to charge a motorist for a 5 hour stay when in fact they made 3 visits to the car park in question.

The new CEO of Asda .. Sean Clarke should be informed of this which shows how Parking Eye scam his customers every day

Similar to the way someone else proved the fact they'd left a PE car park, by showing their phone location records.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    The Fraud Act 2006
Fraud by false representation (Section 2)
    The defendant:!
    -made a false representation!
    -dishonestly!
-knowing that the representation was or might be untrue or misleading!
-with intent to make a gain for himself or another, to cause loss to another or to expose another to risk of loss

Seems to fit the bill to me since they know their ANPR is at best 95% accurate and we've never seen what the 32 checks they claim to carry out actually are.
They make too many 'mistakes' for them all to be coincidence.

Do tell that to the new CEO of Asda .. Sean Clarke

It's his decision if he wants to keep Parking Eye .... it's his decision if he wants more customers or less ?

It's his decision if he wants to stump up the 'n' hundreds of thousands it will take to extricate the company from the contract via any PE-loaded cancellation clause.

Read PE -v- Sommerfield and check out the cancellation of the PE contract by B&Q.

Maybe he'll be a brave CEO and bite the bullet, although I suspect he'd rather his (soon to be ex) customers suck up the PE PCNs and deal themselves with all the sh1te coming their way in the not-too-distant future!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    I know.
I wonder in the contract if scamming was part of it ?
I wonder if Parking Eye could stand up to the power of Walmart ?

I couldn't quite get this use of dash cam. Most of them overwrite the recorded stuff and I would have thought after the time interval for the PPC to send their demand the in and out of ASDA would have been long gone.

What puzzles me slightly is the dash cam photo shown on the PP blog shows a time of 19:25. This appears to be at the motorist's house.

The PE PCN shows a (final) car park exit of 19:28, which suggests he's driven to Asda (presumably shopped), returned to his car and exited all in the space of 3 minutes.

I'm surprised he's not facing a speeding ticket as well.:rotfl:
