Failed credit check but received phone anyway

I've had a pretty weird experience in getting a new phone contract...

I ordered my new phone online via a retailer about 3 weeks ago. I received the handset yet never got connected to the network... After about 3 weeks of back and forth the retailer has finally told me I apparently failed the network's credit check. As far as I know this shouldn't happen, they run the check when you place the order and if you fail you don't get the phone.

The guy in the store said the head office will be contacting me at some point but he has no idea what they'll want to do next. As far as he can tell the phone doesn't exist in the system and he wouldn't be able to process the return if he wanted to. It's possible they'll try and offer me a deal with another network.

The credit check failure is strange to me as I think I have a good score. Only thing I can think is it's because I moved earlier in the year and only recently changed the address for my account.

Other than the upfront cost it doesn't look like they're going to start charging me for the phone as I'm not registered on the network at all. I'm not really sure what can happen next. My main question would be - now that they've sent me the handset, am I obliged to return it to them?

    You are not obliged to return the phone, but if you keep it expect their head office to eventually invoice you the full simfree price for the phone. That could be pretty expensive depending on what the phone is.

    They know they've sent it to you, it's only a matter of time for the paperwork to catch up...

    Last September I pre-ordered the iPhone 6s Plus with Vodafone.

    My credit card payment went through fine but they never charged my account. I set the money aside and contacted them several times informing them I'd not been billed.

    It was earlier on this year before they'd realised I was right and they were wrong and was finally charged for the handset.

    If I were you I'd find out where to send the handset to and mail it via Special Delivery (Signed for).

    No, but they can charge for the physical goods sent to and accepted by the OP. Just like 20aday was...

    In my case I'd imagine the payment failed due to the number of people upgrading/buying new phones at the time of the transaction.

    I was fully aware the goods required payment it was just frustrating Vodafone wouldn't accept the funds hadn't been charged to my credit card until they finally realised their mistake earlier this year.

    As there was no contract formed, there is no agreement regarding the phone.
    In such circumstances, the phone became unsolicted goods.

    They're not unsolicited goods as the OP did request the mobile phone so clearly wanted it. They are goods sent in error. Unsolicited goods would be me sending a mobile phone to the OP.

    So the OP never communicated with the retailer and didn't attempt to buy a phone? Strange the OP says differently.

    I don't think you quite understand the concept of unsolicited goods...
