VCS/BW Legel, Landlord Told Them To Cancel PCN

    BW Legal are not going to cancel. You need to know that is the case. They are a company which uses court as a cheap method of aggressive 'debt collection' which is why you need to alert your MP, the SRA, et al. This sort of thing should not be allowed and certainly the client which contracted VCS should have the right to cancel PCNs and probably do, in the contract with VCS.

    Not that that will stop BW Legal. You should be ready for court papers and you certainly have a defence. the point being, BW Legal do not care, they are even pursuing cases that are statute barred (past the six year limit) and suing plenty of registered keepers even though VCS can't hold registered keepers liable.

    The fact that there is no cause of action doesn't stop them because people ARE caving in and paying in their droves. That's why the Prime Minister and DCLG need to hear about this treatment, as well as the CSA and SRA getting clear complaints about specific breaches of their Codes (not general complaints, specific breaches).


    Another point is that their is a take away as well where the customerss park in the same area and on many occasions the VCS mobile patrol does not issue tickets so could I also argue that I am being unfairly treated as well?

    Yes I would say so, or at least to the week before a hearing, in the hope the OP crumbles. After all, they are pursuing loads of keepers who were not drivers and those cases are hopeless if defended well with evidence from Schedule 4 for the Judge.

  • Well I aint caving in, Ive replied to them saying either cancel it or start court proceedings which I will put up a defence (and landlord said he would also attend) :).

    BW Legal are now giving me nice list of things to send to the SRA as well

    Good for you.

    You might like to ask the SRA what they think the difference is between Peter Rackman and the Kray Twins and BWLegal.

    They menaced vunerable victims and extorted money by threats.

    If it does go to court for you, the outcome will be of national interest.

    But, as coupon-mad says, they will pull out at the last minute

  • Well Finally!!! VCS refered this to higher management after the land owner emailed them yet again and I said either cancel or lets go to court, finally the agreed to cancel the invoice (PCN) just have to pay a £15 cancel charge.

    So fighting them paid off :)

    NO YOU DO NOT !!!! you told VCS operative at the time , HE should have made enquires , instead of sulking off .

    inform the landowner of this companies standards , if he has net realised himself and suggest to him that they get the boot , thru being stupid!

    Personally I would tell them to go and swivel for their fee. They have been told to cancel so they should cancel. That doesn't mean attempt to scrape some kind of fee out of it.

    any fees incured have been incurred by themselves ,

    it also seems that VCS have contacted the DVLA AFTER being told to cancel ticket on car/van XXXXXX , there fore they have broken DVLA KODOE rules , this could and probably is breaking DPA rules
