Appeal only lodged today so no idea when it is likely to be. On the subject of the LL putting the house up for sale the day MOT moved in I have had some ideas about proving this, especially as the LL has totally ignored two requests now for him to own up to this fact. We'll get to work on that. Also it is obvious we need to come up with some fresh evidence and not just go to appeal repeating the same message. MOT is going to completely review all her income and expenditure for the past 18 months and pester her former GP in the Midlands for a report as to her medical history; so far he has not responded to her request. What is it with people? We are going to ask the lady that gave MOT & the twins counselling. Then there are the neighbours D&T who have been absolute diamonds, we feel sure they will happily write something. Lastly the family that were in the adjoining farmhouse when MOT moved in who also had horrendous problems with the LL. As for Shelter, well they are willing to offer advice but don't seem keen to potentially lose another appeal. All MOT wants is somewhere decent to live where she can feel secure for herself and her kids, where she is not going to worry that she might have to move again. Is this asking too much? What century are we living in?0

Have you thought about contacting Shelter's Head Office, and asking for help from there if your local office are unwilling to help?
Also, is there a Law Centre nearby that may also be able to provide some assistance?
Did the MP ever get back to you? Maybe sitting in the waiting room next time there is a surgery may get a response....
Did the Councillors ever show any willingess to help?

Is it now time to pass it to a broadsheet? Local paper first? - yes, I am thinking carefully of all this might unleash. I doubt those in 'power' could be more disposed against mot than their decisions so far make apparent.

Hi MOT, IT and twins
Have started to do some digging on appeal cases. Found this, it is not the same situation, but it is about intentionality. The piece I have copied is very interesting and relevant. Will look for some more cases and send them on via pm.
Floss, Ampersand etc, do you interpret the relevance of this ruling in the same way I do, or am I clutching at straws ?

On appeal under section 204 His Honour Judge Clarke found that the reviewing officer had misdirected herself in law. Under section 191 a person can only be intentionally homeless if she deliberately does or fails to do anything in consequence of which she loses her accommodation that was reasonable for to continue to occupy. The word "deliberately" was of the utmost importance.

Firstly MOT - you are an amazing wonderful woman mother. My admiration for you is enormous. Your children are a credit to you and only go to prove what I have written above.
I went through exactly what you have done, some four years ago and your posts brought back every emotion of the roller coaster ride that you have and are going through. When I moved from a house I lived in for 7 years I had to move in a horsebox!!!!! Suspect the neighbours thought "Oh my lord another !!!!!" I laugh now but it was humiliating, though inretrospect saved me a fortuen and was definately in the spirit of MSE! Our temp accom was dreadful as well but a home is not the four walls it is what you make of it!.
I have had a couple of ideas which are slightly out of the box, that maybe of interest, if you PM me I will PM you my phone number. They are not quick fix solutions but could in the long run give you a secure solution.
As Council Tax is my speciality rather than housing, I must ask if this is uptodate? Sorry to put a downer on it, but if it is not let me know and I wil help you through that particular maze.
Just hold true to the facts that you are an increadible woman and a wonderful mother, you will get through this, I promise and you have many many people rooting for you.
I am going to do some digging around for some facts and fingers re the Local Authorities Housing allocations, and if I find anything intersting I will let you know.

When you are digging thru all the info you are going to use for the appeal, please make sure you factor in the childrens school meals, if they have lunch at school or have sandwiches. This has to count as to where some of your expenditure has been going on. Am I right in thinking that you were paying the rent latterly thru housing benefit. So that blows the arrears situation right out of the water. I agree that you should now be sitting in MPS surgery and demanding help. Words fail me in this situation.:eek: It is making my blood boil just thinking of the hoops the HLO has put you thru.:eek: It is just unbelievable that in this day and age a Mum and 2 children who are in this situation thru ultimately no fault of there own and who have proved time and time again how genuine they are, are still unable to be properly housed:eek: How many people would have taken a flat in the condition that was given to MOT would have turned it into a home after scrubbing everything insight within a week.:eek: Me thinks she is surely the first as the others have either messed it or just added to the mess. But I hazard a guess that they have been offered a nice new perm home:rolleyes: Of course there are going to be others who kicked up more of a stink and played goodness only knows what card and never even had to go into the hell hole that they shoved MOT and children.:rolleyes: I could voice far more extreme opinions which I wont as this is a public forum and is not the place but I am sure that several other posters would agree with.:D
I am sorry MOT and just wish there was something we could do for you something concrete. I have more than enough room to house you and the kids and thats not bragging its just that the kids have grown up and left home;) I would put you up like a shot but you live too far away.
I think of you and the children everyday and send up a little prayer that good sense will prevail and that this situation will be resolved properly soon.
