IMI Mobile refund

Hopefully someone could help me here please. We act as guarantor for teenage grandson's mobile phone and pay the bill. Anyway this months bill was over £40 more than usual, asked him about it and he said he had been getting random texts but never replied (and I believe him). Spoke to mobile provider- which is 3- and they gave us details of who had been sending these texts. They said it was a company called IMI Mobile. I spoke to someone from there who said you must complain via website to customer relations which we did but so far no reply. Has anybody else had similar dealings and if so what was the outcome. Any help appreciated, thanks in advance
