Civil Enforcement parking charge

Hi folks

You must be sick to death of newbies posting for advice so i apologise in advance, I just want to see if i have grounds to appeal a parking charge notice i received from 'Civil Enforcement (creditor) of liverpool.

On sat 28/08/16 I had to visit the out of hours dentist in oxford and as the ooh car park was full, parked in a car park of a closed GP surgery. I now realise the carpark was monitored by ANPR cameras and as i am not an 'authorised user' have been sent a £100 invoice reduced to £60 if paid in 14 days.
I am a student nurse, i do not have £60 let alone £100 to pay and was just in so much pain i was stupid.

Any advice is gratefully recieved.

    Same as all cases, start by reading the 'NEWBIES PLEASE READ THESE FAQS FIRST' thread near the top of the forum, where you clicked 'NEW THREAD'.

    luckily for you, CEL are so very easy peasy to beat at POPLA, providing the driver's identity is not implied or given. The appeal to use is in the NEWBIES thread and quite often, CEL cancel as soon as they see it.

    If not, if they reject the first appeal template, then they'll lose at POPLA stage to a long & strong forum POPLA appeal.

    Yep, use the NEWBIES thread version which may work first time.

    Certainly not the old appeal web template provided from an MSE article - it is not right despite changes made recently and still says 'the reason why I parked why I did was'(!!) and still (I think) whitters on about there being no loss.

  • Have done some further reading and unsure if this PCN is out of time ?

    Issued via ANPR, the date they 'issued' is showing as 26 days after the incident however it was only recieved by myself 30 days after the alleged incident.

    is this relevant here ? (Where no notice to driver has been served (e.g ANPR is used)) Not later than 14 days after the vehicle was parked
  • Yep, it's very relevant - it's one of the many reasons why CEL's Notices to Keeper don't comply with Schedule 4 of the Protection of Freedoms Act 2012.

    CEL have forfeited the right hold the vehicle's keeper liable for the charge.

    Except that you are looking for a deadline that doesn't apply because CEL don't use POFA wording. So the '14 days' date (which comes from POFA, an ACT that CEL do not have to adhere to, and they choose not to) makes little difference except to make it easier later, to explain to POPLA why you win as a keeper appellant.

    You don't need to do anything deep, no digging of detail needed. Just send the blue writing appeal template from the NEWBIES thread and in most cases CEL crawl back under their stone anyway.

    This is a campaign of asking people to keep sending Theresa May actual hard copies of the trash they've been deluged with. Let her advisers' desks overflow with annoying paperwork re PPCs.

    No emails, all letters from genuine people pouring their hearts out. Write to your MP as well as Mrs May:

    The more the better, write it yourself if you are able and enclose copies of the threatograms and rubbish thrown at you.

    Do not do this by email - make your paperwork land with a thump on desks, just like it all landed in a very unwelcome way on your doormat.

    Apparently the DCLG are looking to make an announcement before the year end so let's make MP's and Mrs May aware that action needs to be strong. You can be sure that the BPA and IPC suits are lobbying Parliament and meeting their friends in suits.

    So let the consumers' voices be heard.
