Overpaid?

Hi guys.

So, I left my job last month after 5 months working just to help with finance before I go into my year at university. During my time there I took about 12 days off which was I paid for and during the interview for the job I was asked whether I'd need any holidays so they can book them now for me and they made me aware I would get paid for the days I took off. (no mention of ever having to pay it back).

Today I just randomly checked the online pay slips to see if I'm entitled to any commission but instead I see it says overpaid -£286.38.

What happens now? surely they can't take the money from my bank?

Thanks guys.

  • If you have been overpaid, you will need to return it.

    Well it depends.

If you were working full time for 5 months, then you are entitled to approximately 11 days off.

They cant take it from your bank, but they can take you to court...
  • would they though over £238?

    I don't know.

I would. A small business probably would. Any business with in house legal probably would.

Why are you not wanting to pay it back? Essentially it's theft, just unlikely the police would act

Domestic and general, thats the company I worked for, pretty big business worldwide.

How is it theft though? I made them aware of the days I needed off when asked, and they told me they would pay me for it too? not once did they say I would have to pay it back.
  • Some employers would! Yours? Who knows?

What would you do if they owed you the money or don't morals come into it?

Well worst case is the police actually get involved, but that's very unlikely

Next step down is a CCJ, which you don't want

Next down from that is you actually manage to pay in time which would be approximately £500 + the 238

I'm confused.. what do you mean 500+ the 238?

Wrongfully keeping credited money is against the theft act - rarely do the police act
